Why is it parked in 1st gear instead of park?

the little lever that blocks you from taking it out of park when the car is not on is broken. It doesnt affect the car at all though. The tranny shifts fantastically. I took the pic with it in first because I had just fixed the radio surround and had to move the shifter to that position to get the plastic back on.
