Police officers reprimanded after parking car in disabled space at Congleton Tesco
Two police officers have been reprimanded after parking their patrol car in a disabled bay.
The 4x4 police vehicle was spotted taking up a designated disabled space in the Tesco car park in Congleton.
Shopper David Horner – who is a blue-badge holder – challenged the officers inside the store but was 'intimidated' by their 'curt' response.
He complained to Cheshire Police's professional standards department, only to be told that the vehicle could not be traced.
However, after The Sentinel contacted the force, Mr Horner received another call to tell him the officers had been identified and spoken to.
The 62-year-old, from Congleton, said: "I was incensed when I saw this police car had driven into the parking bay. It was snowing so you couldn't see the lines on the ground, but there was a big sign.
"I approached the police officer in Tesco and asked if he realised he had parked in a disabled person's space. He responded that it was snowing and he couldn't see the lines. He was quite intimidating. If it was on a public highway it would have been a road traffic offence."
Mr Horner took a photograph of the car and emailed a complaint to Cheshire Police on January 18, but a week later received a phone call to tell him the officers involved could not be traced.
After pressing the matter further he received an email from a member of the professional standards department, which said: "I have made extensive inquires to trace the vehicle as per your complaint.
"The systems we have in place do not give the facility to trace the vehicle. I am sorry I cannot progress the matter any further."
Retired health and safety manager Mr Horner said: "I could not believe they could not identify the vehicle.
"Then I had another phone call from a DCI who was very apologetic and adamant I should not have been told that, and the officers had been identified.
"The whole thing was pretty shoddy."
Disabled spaces in supermarket car parks are not legally enforceable. A Tesco spokesman said: “We understand that the thick snow meant the officers couldn’t see the markings on the space. Our disabled car parking spaces are provided for the benefit of those who are blue badge holders. We ask all our customers to be considerate to other shoppers in their use of these spaces. Where we are made aware that non-blue badge holders are parked in these spaces, we will of course ask them to move.”
A Cheshire Police spokesman said: "The professional standards department has conducted inquiries to establish the driver of the vehicle.
"The officers concerned have been given words of advice regarding their choice of parking space and the manner in which they spoke to the member of public who had pointed out they were in a disabled parking bay. Cheshire Police expects the highest standards from their officers and staff at all times. On this occasion, the officers' conduct and decision making fell short of what is expected."

Officers participating in this program will perform their assigned duties with the body camera affixed to his or her person for recording of their daily activities. I suspect that what the Brain meant to say was "...to go protest against corporatism..."
No doubt that there is a small segment of the entitled-suburban-rich-kid community who genuinely believe themselves to be anti-capitalist, but I'm sure that the much larger group of the "I am desperate to be seen rebelling against something which I don't understand" crowd are philosophically opposed only to the idea of large corporations (Starbucks, Apple, Hot Topic, etc) being allowed to function in a free market.

The family of a 35-year-old man shot to death by Long Beach police after they mistook a water hose nozzle he was holding for a handgun was awarded $6.5 million in damages by a federal jury Thursday.

Indiana Supreme Court Declares An Officer's Testimony Is More Reliable Than Video Evidence | Techdirt

Videotape evidence can be overruled by the testimony and after-the-fact interpretation of a police officer, the Indiana Supreme Court ruled last week. In a 6 to 1 decision, justices overruled the state Court of Appeals which reviewed dashcam footage of Joanna S. Robinson driving her Chrysler PT Cruiser at around 1am on October 15, 2011 in Elkhart County and found no evidence of a crime.

One of the very first things that they taught us in Criminal Procedure was that eyewitness testimony is pretty much the least reliable form of admissible evidence known to jurisprudence.

I'm sure we can all think of situations in which something was not quite what it appeared to be. Video evidence, by itself, is not always a foolproof and reliable indicator of what actually went on, and courts are leery of setting unintentional precedent.
Short of putting the Lord God on the stand under direct questioning*, it's impossible to name any one single source of fact which is entirely reliable and indisputable.
* = in 2007, Nebraska State Senator Ernie Chambers filed a lawsuit against God, seeking a permanent injunction against His "certain harmful activities and the making of terroristic threats." He was granted a court hearing, however the suit was dismissed when Sen. Chambers was unable to provide the address of a known residence for God, thus precluding the service of process upon The Almighty.
I love it when people do interesting things like this in the courts.

Just before 1pm last Dec. 13, Nicolas Aquino was enjoying what I like to think of as the constitutionally protected right to sit around his own home wearing comfy clothes on a Saturday afternoon. His wife was out and Aquino was kicking back with their two little dogs, plotting nothing more than Christmas shopping.
And then the dogs started barking that kind of relentless bark that happens when someone is creeping around outside.
Aquino, a U.S. Air Force captain and Naval Postgraduate School student, took his hoodie-wearing self to the door, peered out the window and saw a guy wearing a uniform. Aquino stepped outside, closed the door behind him and asked, “Excuse me, can I help you?”
Monterey Sheriff’s Deputy Ivan Rodriguez responded he was investigating a report of suspicious activity in the area – specifically, as Rodriguez’s written report would later describe, “an adult Hispanic male wearing a hoodie” walking around and into a Carmel Woods’ residence. It seems one of the neighbors told Rodriguez “he was suspicious of the male at 24591 Portola Ave. and that ‘I should keep my eye on him.’” Aquino had lived in the home for about 10 months at that point. He was walking around outside looking for a UPS package that had been delivered.
Rodriguez, according to his written report, asked for Aquino’s ID. Aquino asked him if he was being detained. And that’s where things went straight to hell. Aquino says he reached slowly into his pocket, got his wallet, took out his military ID card and held it up for the deputy to see. Rodriguez says Aquino refused to hand that ID over, while Aquino says the deputy told him a military ID didn’t prove he lived there. Aquino said he was going inside to retrieve some bills that could prove it, and says that’s when Rodriguez tackled him.
“He doesn’t say anything. He grabs my wrist, puts me in a front guillotine, spins me around and I land on all fours,” Aquino tells me. A construction worker from a project across the street ran over and helped pile on.
A second deputy arrived and Aquino was handcuffed and placed in a patrol car. “I told them, ‘I don’t consent to a search,’” Aquino says. “They went to my door and it appears they went into my house.”
About 20 minutes later, Aquino was released. The deputies let him get his bills and prove he lived there.
Aquino claims the deputy took him aside and told him he could have avoided the confrontation by knowing his neighbors. And then, according to Aquino, the deputy said, “You started this by not giving me your ID.”

There was a dispute Wednesday afternoon between a parking enforcement officer in San Diego and a paramedic with Rural Metro over how the ambulance was parked. Rural Metro is contracted to provide EMS for the city and according to news reports the medic said he was assisting someone when the incident occurred. This battle turned into wrestling match right in front of the public.
