Default Just got in an accident...

Well... worst day of my life.

Anyways, i was going to visit my friends in the hospital when a guy ran a red light and smashed into my right rear. The miata then spun around and got stuck between a tree and a light pole....

they guy is saying he had green. I said that he didnt, and so did my passenger. But i dont know what's going to happen. The guy was a crazy british dude who got out and immediately started screaming at me, calling me a "******* idiot ******." He also said i "dont deserve to be on this planet"

other than the smashed in rear 1/4, the car is pretty much fine.

The thing is, this was my first accident. Im only 19 and im in college, so my parents are about 800 miles away. I have no idea what to do.

The cop couldnt tell me where the car would be taken, and i couldnt wait for the wrecker to arrive because i had to get in the ambulance. The car is very modified (link'd greddy, intercooled, 1.8l diff, etc), and is worth a lot to me, but im betting the ins. company will total it.

I would like to get it back to take all the parts off it, but i dont have a driveway or garage to put it in.... what the hell do i do?!

Anyone know anyone in the savannah ga area?

oh,**** man .you just finished painting it.thats sucks.try to get it back so you can take your stuff out.rent a parking spot or garage.they might repair it though.are you hurt.

im not hurt (a few airbag burns and bump on the head)... im just extremely stressed. i doubt ill sleep tonight.

i have no car... no way to get to class... no where to put this car... and i have no idea what that crazy dude said/is claiming... or if the cop believed him.

i didnt tell the cop about him screaming at me or anything because i just didnt think to... i was so shaken up. ugh

do you have a police report for the accident? If not do so, then get a report for assault that you endured from the other driver(if he threatened you).

Call your insurance company, try to find witnesses, including your passenger.

Do you have pictures of the other guys car? That would be helpful. Car is probably in the city impound which i hope not because thats $$, but you might get the guys insurance to cover it.

Check to see if the streetlights have cameras on em or any of the buildings around have security cameras towards the street. All of this can be done during a day off or an afternoon or two

I don't think your insurance company will total it. I had a grandma lady cross three lanes and hit the front passender end of my car, and side swipe me. After that I hit the back passenger side just like you, but into a guard rail on the highway when I hydroplaned and spun out. It sort of looks like yours did. But still was fixable, even part of the frame bent, they had to bend it back into place. I think Miata's are pretty resilliant and fixable.

Only bad thing is, it may never drive the same agian, but mine still seems too.

Good luck with that though. Only problem you'll have from insurance company is if they think the car is worth $4k and repairs are like $8k. Check the bluebook value on it.

Not sure who you use for Insurance, but I have Allstate. For the first accident I went with who I wanted to go with, to fix my car. Came out perfect. But for the Rear hit I went with an "Allstate approved" collision shop. I will never do that again, as an "approved" shop means they have to get used parts from a junk yard and try to use those instead of new parts. If they fail to use, used parts, three times then they can go new. So basiclly, an "approved" shop will use the cheapest method to get you fixed up, vs the right way it should be done.

You need to contact the towing company asap.
Theyre storing it at their lot...at YOUR expense...so every day that goes by adds to your bill. I would have the car towed FROM their lot to your house (whatever) then you can pull whatever parts you want from it.
It will be declared a "total" I am quite sure. To replace a rear quarter and straighten inner workings will cost 3k plus at most any body shop. Theyre not going to fix it.

gl man that sucks i had the same type **** happen to me and the stress contributed greatly to me not being in college any mor i hope you come out all right.

With that kind of damage to the rear quarters, I'll bet money that car is totalled by insurance. Unless you had it insured for a specificed value, you really need to do your best to start pulling parts off the car as soon as you can. The first step is getting the car back in your possession (after doing all the things Loki mentioned for fighting your accident case). Because your other battle is going to be with the insurance company and what they're going to pay to replace the car. That's the real pitfall with fixing up sort-of-old cars, but keeping them insured as if they're "old cars". You'll need things like receipts to prove your point for stuff you can't pull off- like the new paint job. For comparison my brother-in-law just go rear ended in a 90 he bought from my sister. Even though the car had 285k on it, he managed to get $3500 citing it's recent repaint, a new top engine swap at 185k, among other things. I think this is a case of the "squeaky wheeld gets the grease". You need to be a real whiner. Good luck.

the ins. company should give you the option of keeping the car if they total it out. meaning, they let you keep the car plus a check for the difference in price of a damaged vs undamaged car. and definitely get a copy of the police report. I would find that pompus Brit and curb him, I promise he wouldn't be calling anyone names anytime soon. If you don't know what curbing is, watch American History X.

If you can't find any witness to name the other party at fault (your passenger won't count), your insurance company is going to have to cover it under your comprehensive plan (not colision). They're going to total it.

First thing, get that car out of the impound lot. Nothing good happens there. I assume that it's drivable? If so, drive it to your house/dorm/apartement, whatever, and throw a car cover over it so nobody can complain. You want the car in your posession so you can strip the turbo, link, wheels, and whatever else of the aftermarket stuff you can return to original.

You can try getting security camera footage, if any exists. The shops probably won't let you review their footage, though. And if they did capture anything, they probably won't give you anything without being ordered by a court to do so. But you can give it a shot.

You need to JUMP on this. Get the car out of the towing yard TONIGHT. Send a friend, a relative, someone down there to keep an eye on it. The guys at the towing yard will take the nicer stuff out of your car if you leave it there. Get the car out, pull everything you can off of it, then buy it back from insurance and part it out/scrap it.

Sorry to hear about the accident. :(

i cant get my car out of the lot, because the office is closed till monday morning. The lot is surrounded by 8foot tall electric fencing...

and no, the car is not driveable. look at the pass. rear wheel. its tilted in at the top.

my ins. co still hasn't contacted me for a statement, or my passenger. If he "doesnt count" then why do they need a statement from him?

Its clear the guy wasnt paying attention. I was in the left lane traveling east, and he was in the right traveling north. He had the maximum amount of time to slow down, but he didnt see the light or slow down, resulting in him hitting my rear 1/4.

well... got it back from the wrecker today, and cleaned out the junky shed in the back alleyway



no word from the ins. company yet. they are closed till tomorrow
it's def. totaled. look at the top. the whole thing is bent, thats why its not tight anymore :( my baby
