Default Paypal dispute with "MiataMX5"

A few weeks ago I sold my Link ECU to a member here by the name of "MiataMX5".

My FS thread is listed here.

https://www.miataturbo.net/showthrea...light=link+ecu

A day after he sends me the money, he says "Hey I don't want it anymore please refund my money". The problem here is I had already sent the unit away... very nicely packed and fully insured.

Today I get a PM.

Now, 5 minutes later I get this in my email..

New Significantly Not as Described Dispute: Case #PP-000-947-570-401‏
From: service@intl.paypal.com
Sent: April 26, 2010 6:17:20 PM
To: aaron.witzke@hotmail.com

Hello Aaron Witzke,

Jeff Houston has opened a dispute for the payment made on Apr 15, 2010
indicating that the item they received did not match the original
description.

Jeff Houston has requested a $320.00 USD refund.

I am under the assumption when selling a product that the buyer has done their research and knows what they are buying. Throughout the transaction he made it sound like he knew all about the Link (I can't show these PM's because I deleted them due to my inbox being full).

So what, MiataMX5... you didn't know you needed to spend an hour swapping wires and now want ME to refund you your money? You should have known that it's not a plug and play ECU. It's not my responsibility to tell you this. I listed the ECU in my FS thread with everything a buyer needs to know. 1) What it comes with 2) How much I want. I did this and now because of your own lazyness to research a product you want me to refund your money.

Hell no.

If it is in fact broken, give ME the opportunity to file an insurance claim before blocking up my Paypal account which I use on a daily basis.
But do not file an illagitamant claim. You said it's "broken" but now you file a "Significantly Not as Described Dispute:"

I will be calling Paypal directly tomorrow and taking care of this. You could make both of our lives easier if you just closed the dispute.

Good thing you have his pm's. You can use them as evidence.

I don't.

The gay *** 25 limit PM box isn't helping my situation. I've been PMing with another member here daily about my Megasquirt which filled my box up VERY fast.

This is ridiculous.

You can export PMs instead of deleting them. Also if you subscribe your box will hold 500 instead of 10 or whatever you have now.

You should get in contact with someone at paypal 402-935-2057 and let them know the way he is changing his story. Sounds like he was gonna pull a scam on the ins in the beginning and now he thinks its easier to scam you. Sorry for your luck. Where is he located?

I've escalated the dispute into a Claim.

We'll see how it goes.

I'm on hold right now. I was talking with a guy and he seemed quite helpful. He is looking through some of my proof right now.

Success.

Paypal closed the dispute.

He is claiming now that insurance only covers "shipping in Canada". I know this is false because I paid extra $ on top of the shipping charge (out of my own pocket, I didn't charge him) to make sure it was fully insured.

I directed him to the Canada Post website. He can deal with it himself now. I would have helped if he asked nicely but now that he's just pissed me off and made me spend $$ on long distance with Paypal he can go at it alone.

See what trying to scam gets you?

This was my thread that started off great discussing the rarity of the guitar, which later turned into a story about my Paypal situation. Thankfully, karma was on my side and all ended well.

I am not trying to rip anyone off. The reason I asked for you to refund my money before you shipped it out was because just a few days before you listed this for sale I saw where you couldn't get it working on your car and you had it listed on here as it worked great. I was just looking at some of the question on here people have had with the link and I saw your were you could not get it running. But you assured me after i emailed you that you did in fact get it running and it ran well for about an hour then you removed it (that sounded kinda wierd if you ask me it runs fine but i think i am going to take it off???). Also you said you had a serial link to hook it up to my computer but instead I recieved what looks like something you tried to make yourself that dont even have any type of housing its just like a motherboard with a connector on each side. Me and a friend of mine put everything on it using the flyin miata instuctions and I tried to connect it to my laptop with a serial to usb cord and it wouldn't work so I went and bought a serial cord and dragged my desktop into my basement just to find out that it wouldn't connect to the ecu either imagine that. Now who seems like they are doing the scamming? I wouldn't advise doing bussiness with falcon he seems to think if you break something just sale it. Also the reason the paypal claim was closed is because they cannot deal with claims that are out of the US unless they are through ebay. I found that out after I called them.

I also contacted kieth at flyin miata earlier to try to get some help and he had me open it up and get some numbers off the chip on the computer and the numbers had been scratched off.

I already told you what chip it was. The numbers are not scratched off, I could read them just fine.

6243 would be the board serial number. It's for a 90-93 Miata, originally sold in 2002. According to my records the last chip revision the ECU got was 416M0718.

In the Link tuning manual on pages 5-6 loading in the appropriate default map is covered. Thanks.

I already explained ALL of this to you. The LINK works. I drove the car around for like an hour on the base map. The next morning the car was having cold start issues. I managed to get it running again after playing with the Master Fuel.. Since I needed to drive the car around for a few weeks to and from work before the dyno was another reason I pulled it out because I can't miss work due to a temperamental car.

After that, I ran into a member here who builds megasquirts and due to the large support for it on here and that I have someone local who can tune it I decided to sell the Link and order a MS.

As for the Link adapter which was made by another member on here for me (and I told you this), it didn't work with me at first as well. You need to properly set the COM ports in DataLogLab and on your computer to match. After I did that, it worked and hooked up without a problem to my laptop with a USB->Serial converter. Ever think perhaps it's your cable that doesn't work? Not my adapter?

You also say the car doesn't want to start. Did you change the base map or not? It's set to the turbo 440cc injector map right now so perhaps that's why?

The dispute was actually closed by the fellow I spoke with on the phone. He read through everything I had emailed them, which was a lot including PM's from you and he said they closed it because it looked fishy, which it did.

So which one is it? You claim it's broken, but it left my possession in working condition in a VERY well packaged box with tons of cushion. Then you claim through paypal that it was "not as described".

I told you I would help you with the insurance claim. I don't have $320 to give back to you and deal with the claim myself. If it did in fact break in shipping, it would not have happened had I not shipped it, correct? So why would I have to deal with it, since it worked when I had it and it only allegedly broke when I shipped it to you? I put EXTRA insurance on it to make sure it was over insured out of my own pocket just in case of a situation like this.

Insurance is valid in the USA. I made sure of that. Every part I've ever sold online is always fully insured.

I have never scammed, though of scamming or plan to scam ANYONE before and am insulted that you are claiming that I did.

I learned 2 things from this thread. #1: whoever has a link needs to threw that outdated more than an apple IIE piece of crap in the trash cause you'd be an idiot not to run a megasquirt by now. #2, if you have a link and sold it to buy a MS, +1 to you. If you bought a link instead of an MS, hold your head underwater and count hold long it takes before you pass out.

I gave Jeremy the numbers that are on the chip and he was able to figure out it was a 416M0718 chip.
