i agree, i think hes just trying to milk the ebay/paypal system which favors the hell out of buyers. i'll never sell anything bigger than a couple hundred dollars on ebay, because you can pretty easily get screwed out of the entire thing. the biggest thing i ever sold was a laptop for about $600... i was biting my nails for the next month praying that the guy didnt file a claim. there was nothing wrong with the computer, but it was a little beat up externally (disclosed in the auction), and people are ********. i lucked out, but it seems you didnt.

really you should have put something to the effect of "sold as is, i'm no guitar expert so if you need detailed info or photos, ask"

Over the years I only had one dispute opened against me and it was for a Dell server I sold, coincidentally for my same brother.

They guy got it and said he couldn't boot it past the bios screen, etc etc, I didn't really understand what he was saying. My brother gave him free email support to help him, but he was stubborn and insisted on his money back. He open a claim saying it was DOA. I forwarded all emails to and from concerning the server, and that it was in fact not DOA. Took awhile, but I won the case.

Then the guy emailed me something about a baseball bat and showing up at my house. I told him to go right the **** ahead, but that I wouldn't recommend coming here. lol

I'm going to email the guitar buyer now. I figured I would make him wait until this morning to stew things over and let him realize what a jackass he's being. We'll see how this goes.

I'm going to make it short and sweet. "I had a 3 day return policy, you should have asked me any and all questions concerning the guitar prior to even bidding on it, and I will not accept a return now that it has been handled." Something along those lines. Then if he writes back throwing a fit or threatening me, I'll write a more detailed email back.

In response to those 2 emails he sent me;

"I had a 3 day return policy and it has been 8 days since you received the guitar. The guitar was listed as "1983' baretta in good used condition", and I feel that in no way was the guitar misrepresented in the listing. It's a 27 year old guitar, so the solder might have come loose in shipping. I can refund you $20 to have the solder fixed."

Cant wait to read the response.

I just got off the phone with eBay and had a account representative review the listing. I explained everything to him and went through some of the emails I had with the buyer. He assured me that if it goes to dispute, which it inevitable will, that I should be confident of a win.

He said eBay cannot do ANYTHING for me until a dispute is opened, so I pretty much emailed the guy telling him to go ahead.

"The guitar was in fact playable when it left my hands. It was listed as a "83' in good used condition". I had a 3 day return policy on it and that was to insure there was no damage via shipping and that you were happy with it.

I just got off the phone with eBay and spoke with a account representative about the situation. He assured me after reviewing the listing and the information I gave him from emails between us that I should be confident if it goes to a dispute.

I am sorry you feel this way and that you are unhappy, but unfortunately we will have to go through eBay's dispute process if we must."

The rep even said "sounds like buyer's remorse". Unfortunately, that's not my problem. Apparently this guy didn't read eBay's terms and conditions when he signed up. There's no "hey hey hey I want that soooo ******* bad, I'm gonna bid I'm gonna bid yes yes yes!" .........then days later you regret it, a friends says "lol you paid HOW MUCH for that?!", or your wife finds out. I am simply a seller, and you are simply a buyer.

I'll have to see what he writes back and I assume I'll be back on the phone with eBay by the end of the day.

Well since I sent that email yesterday I haven't heard from the buyer, eBay, or PayPal. I'm thinking he might be on the phone with them discussing his options before he actually makes the claim.

Whether he goes through with the claim or not, I'm almost sure he'll leave me negative feedback. That will be my first one in 7 years if he does. ******* dick!

Don't worry about it, you're stressing over nothing for now until he at least tries to do something. As a buyer I wouldn't be deterred from buying something from someone with 7 years of good reviews with only one negative, I'm pretty sure most people feel the same way. Good luck.

Not really. I actually have alot of things going really well for me! Working for myself is such a great feeling man. Things are picking up every week and I have more **** lined up to sell than I can really handle at the moment. Not to mention I have the absolute best girl in the word to spend my time with and shes very supportive of me.

The car has been a bastard since I first took it apart in 04'! And when dealing with people directly as your own boss I guess you run into problems. I take the good with the bad. Lets put it this way, I've learned to relax and deal with **** a whole hell of alot better than I used to. Its funny how living life with the right person can really affect you and keep you happy. Life has changed tremendously for me in the past 6 months.

I will handle this situation and come out on top.......I ******* hope! lol

If you end up having to give him a refund, claim the thing is damaged when it gets back to you (not as a result of shipping but rather by his guitar "expert" considering it probably will be anyway) and sue him or make another claim AGAINST him via pay pal, probably take a while but I think you'd end up gettting your money out of him over it.

Sorry bout your bad luck dude, exactly why I refuse to use paypal even for something as small as a $3.50/month membership here (speaking of which still need to get that damn money order to Rick )

The guy finally opened a claim saying "item not as described".

Paypal is ******* with me now saying that ANYONE that uses Paypal and buys online has up to 45 days to request a full refund. That even though I had a 3 day return policy, that basically they override that.

And that if I escalate it to a claim, rather than the dispute it currently is at, that I would most likely have to refund the FULL amount and have the guitar returned to me.

I tried to explain to the lady its not the money. Its the fact this guy already has the guitar and has taken it to some shop somewhere where its been molested. Its decreased in value simply due to this transaction!

I'm really at a loss for words right now. This fucked my whole **** up. I had packages that had to go out today, but with my Paypal account tanked $3600 into the negatives I can't do a ******* thing. Not to mention the money I had in the Paypal account that was for clients, not even my own.

Still waiting to hear back from my bro on what he wants to do. I should have kept this family favor out of my actual business affairs.

If it comes to that, do what you can to document the lost value, which could be substantial, try to recover that and then relist it. Hopefully, the two payments will cover it. In reality, he was hoping for $2k IIRC. If you can get $500-1000 in lost value, it will resell for enough to get him to at least $2K and he still comes out OK.

The other thing is to talk to your brother about a substantial cash payment to "fix it" to keep it sold. He did make that original offer. Maybe a $1K refund will kill it. Again, he still ends up with more than he planned to get.

The guy said he would be happy with a $1500 partial refund, which would still leave my brother with his initial $2000 he wanted. Problem is, because it was sold for a larger amount I took a bigger cut as well.

Also, taking the guitar back and re-listing it is a complete waste of my time now. At the time when it was listed I had numerous emails from buyers saying if the winning bidder flaked on me that they wanted dibs. But now after all of this.....I'm almost sure it wouldn't be worth the same as it was 30 days ago.

It just kills me that this guy made a claim on it. It was listed as "good used condition". He asked NO questions prior to bidding and was happy with it once he opened the box. Now all of a sudden its a piece of **** and he's not happy with it.

BTW. Paypal also said that ANY emails between the buyer/seller could not be used in the case. Also news to me.
