Default Dispute with naarleven

Here is the story.
First I paid naarleven $320 through PP for a KOYO radiator, Mishimoto fans and shroud on July 23rd. I received the parts a week or 2 later, I proceeded to open the back and saw that both fans were broken, due the way it was packed, the way it was handled, or both. (Doesn’t matter). Naarleven responded to my email immediately, and offered me $40 dollars for the damages. I respectively declined since he had insurance in it. I did all I could with FedEx to get it taken care of, but the actual claim had to be filed with the person who bought the insurance, Naarleven. All was good; FedEx came and picked up the package to be sent to their claims department to be checked. Some time had passed and no word. FedEx could not give me any info, and Naarleven had no idea what was going on either. I told FedEx to ship it back to me when they were done, but sure enough Naarleven eventually found it on his doorstep with FedEx denying the claim. We agreed on $50 to be refunded to me and to ship the parts back to me, and we would call it even, this was the end of September. On October 29th I wrote that I just wanted my money back since it was taken so long. He sent me an email on November 1 stating that he had something to do with a political campaign, and was very busy due to the elections, and said he would send me my refund on Wednesday. I completely understand being busy so I waited till Wednesday, nothing, emailed on Friday, and still nothing. Now I’m pissed. He has not responded since November 1st when he said he would refund my money. It has now been a month so now I take it as he is going to steal my money. I am posting this in hopes of some sort of resolution.

Sounds like a problem with FedEx. It was missed in the linked story about FedEx shipping the item back to the seller so it was assumed the buyer did such action. Sounds like both parties want to fix the problem, which is nice and there is no trash talking going on for once.

Either ask to get the item sent to you and the $50 refund or the amount in full....sounds like the seller is willing to do either

His last post was on the 18th. I have tried emailing him, and nothing. I did not ship it to him, FedEx did. If it actually happens, I think I would be willing to take the parts back, but after the extra damages, I have no idea if $50 would cover the damages.

yeah, looks like fedex damaged it on both directions...

"I just make a dispute thread on Mt.net. One of the first responses was a link to yours, which I had no idea you did.*I'm not sure what you plan to accomplish by doing that. You agreed to a full refund, and apparently you are backing out .You have yet to answer any of me emails, yet I know your alive. As I stated in the post, I will agree to refund, and have the parts sent back to me if you are just out of money. From your post 50 dollars doesn't seem to cover the damages at this point. This sounds like the best plan: take pics of the parts and send them to me, we agree on a refund amount, you take it back to FedEx and have them ship it back to me on their dime since they screwed up shipping it back to you, have them look at it and you get them to package it. Now if they screw again we have pics and FedEx will be the ones to package it. Please keep in mind I have been very patient this whole time, so please get back with me asap.*

All I can say is good luck dealing with Fedex claims. I mailed a piggy back ECU with a PnP harness once upon a time. New box, plenty of packaging and tape etc. etc. It showed up in a different box with no ECU, and Fedex denied all claims after a huge hassle.

Really? I feel like if you yell your way to a manager and then his boss you can usually get what you want if you are actually in the right.
