It's not supossed to be fair. nothing is, nothing will be.


I sold free ice for $10 a bag, becuase I was smart enough to drive to the factory and fill up my car with the bags they were giving away.

I provided an awesome service and got paid handsomely for it.

I don't think you understand what "by definition" means.

Resources become scarcer, demand goes up, prices go up as a result. As prices go up, people are less inclined to waste or purchase unnecessary quantities. As people curtail their purchases, the remaining inventory is reserved for those who were by circumstance unable to be first in line.

For those of you concerned that our government isn't pushing innovation and technology fast enough, rest easy! We're getting new mileage standards.

Any day now, the Obama Administration will adopt the latest mileage targets for passenger cars and trucks sold in America: an average 54.5 miles per gallon (mpg) by the year 2025.

I honestly don't know why we need new mileage standards. Can't government just fix the price of gasoline?

Kind of nit-picky, but that is an elementary theory, based on an efficient market hypothesis model. One I would assert is much more applicable inside of classrooms than out.

Giving the opportunity to purchase to a greater number of people is more fair than selling it to those who have the ability to drop whatever they are doing and be first in line. Neither is fair in any ultimate sense, but one is more fair than the other, in my opinion.

Meh. I'd still argue there exists a price at which consumers will curtail their purchases. Would prices rise fast enough to actually curtail purchases within the 2 or 3 days before a hurricane hits? Maybe, maybe not.

it's not more fair. It's just as fair/unfair as anythign else.

the store owner has every right in the world to sell a product for wahtever price he wants, and you have every right in the world to either buy it or not. Is it fair to the shop owner to be forced to sell a product less htan market value? just so you feel good inside?

I, alas, am old enough to recall the 1970s. An especially vivid memory is from the summer of 1979. One Friday at midnight my father drove to a gas station to wait in line for that station to open the next day at noon, when he’d then be able to buy a maximum of five gallons of gasoline. Dad waited in the car from midnight until 6am. I – having walked, in the early dawn, the mile-and-a-half from our home to the station – took over for him by waiting in the car the remaining six hours from 6am until noon. When the clock struck 12, I bought five gallons. Driving home, I didn’t dare waste precious fuel by running the air-conditioner.

Neither my father nor I were deceived into believing that the price controls kept our cost of acquiring gasoline low.

And I'm seriously disappointed in people claiming to be "critics of evolution". Many of them can't even tell the difference between the big bang theory and the theory of evolution.

You should more about house and senate rule changes just about every 4 years, because they are always enacted to hurt the other party, but needing to be changed when the same party wants to do the same.

The foreman has slightly less idea about patent law than, ****, I don't know. I'm having trouble thinking of someone on here that is that clueless.

Vel Hogan: It was about a particular, ah, patent, ah, the '460 patent, and whether or not the prior art really did invalidate that pattern, that patent and so with that moment I had, I realized that the software on the Apple side could not be placed into the processor on the prior art and vice versa.
Seriously. I cannot begin to express just how....incredibly wrong that is.

Prior art doesn't even require an implementation. You can write it down in theory on a paper, and that has been held in the past to be sufficient for prior art! The more I read, the more I want to start accusing the foreman of being an Apply fanboy - this is just....holy fuckity ******* **** wrong.

its not the job of the foreman to understand the law.

it's the job of apple to convince the foreman/jury that the law was violated and the job of samsung to convince the foreman/jury there was no violation.

And if the Foreman instructs the jury completely incorrectly, with no basis whatsoever on current law? In fact, his instructions directly contradict current law?

This is what has my panties in a bunch Brainy. The foreman guided the jury through a process based on his own opinion - and his own opinion directly contradicts our current law. It's a complete and total ******* 180 from any intellectual property law we've ever had in the history of the US, and he likely completely ignored the jury instructions with respect to this part.

For my profession? This is absolutely terrifying if it holds through appeal. Seriously. We're (My profession we're, not MT we're) so unbelievably fucked if the foreman's opinions are held up in court - it's nigh impossible to have prior art, which means the patent and copyright wars are going to entirely new levels.
