I just got some new brakes and got my new Air temp. sensor in and the car retuned and then the day after the car is totaled. Talk about bad luck... Had over 10,000 dollars in the car and am probably only going to get about 2,000.

I am going to buy it back and try to part it out. So a heads up for everyone. Will have a FMII turbo kit (only 1 year old) Flex coilovers ( half a year old) Koyo radiator (half a year old) 3" exhaust DP back ( half a year old) and much more. The appraiser is over right now but he is doing some paper work. I'll let yall know the final decision so I can start lining up parts to sell. The accident was in no way my fault. Just posted this on miata.net as well. Trying to recoupe as much as I can from this loss.:mad:

I'm with this guy. Been there done that.

You could probably find a straight chassis for less than the combined loss you would have to take on the drivetrain components. Plus, it really isn't that hard to swap over all that stuff on a Miata.

And you'll have your turbo car back!

I'm going to try and pix up ASAP. The accident happened on a street called Hilcroft. It has 3 lanes on both sides for a total of 6 lanes. I was in the middle lane going about 30 mph ( posted speed limit was 35 you'll see why I said this later).

There was a car on the right lane that was about 2-3 car lengths in front of me trying to turn right into a parking lot. This woman came straight out of that parking lot the car on the right was turning into and came straight across the road. She pulled out in front of me when I was about 20 feet away. I just got new brakes and it was a pretty good test, but couldn't stop quick enough and hit her.

My front right side hit her front left side. From what I can see the intercooler is ok and the radiator is ok. The impact was pretty darn hard. Threw my glasses right off my face. Air bags didn't deploy ( actually glad they didn't). Shoulder is a little sore and my nexk is too but thats it. No one was hurt in the accident.

One thing that made me furious was when I got out I said " What the heck are you doing" her reply back to me was "well if you weren't speeding so fast you wouldn't have hit me" I was thinking WTF!?!? Just cause one car is stopped on a three lane road doesn't mean the other two lanes are clear. If I didn't hit her someone else would have. Honestly I can't believe I didn't get rear-ended.

I called the police and they were on their way. I got her information but she was trying to leave. I told her " if you are going to try to argue that it was my fault then you need to wait for the police to come" she said something like " I can't wait for this Bull$@#% I have to pick up my kids( she was about 20 years old). I said you know I have a witness ( had a friend in the car) and she said she did too. She said her sister was right behind her in another car.

Her sister who she called after the accident happened took about 5-10 minutes to get there. Obviously if she was right behind her she would have been there right when we pulled into the parking lot and also she would not of had to call her too. She seemed really sketchy actually. So I went back to my car, but then I remembered I didn't get her drivers license number.

So I got out and started walknig back to where she parked and she started to leave. I started a light jog to chase her and then stopped when her sister ( who was getting into her car from where "other car" was parked) said " what do you need" I told her I needed to get her drivers license number. She said well she is just moving her car so it doesn't get towed.

I'm like its jsut as likely to get towed right here as it is over there. So then the sister gets in the car and drives over to where the girl parked. I'm just walking over there. When I get into the line of sight ( she parked around a corner of a building) I saw the girl get into her sisters car and they start to leave. I started into a dead sprint chasing after them. I caught up to them and was saying "what the hell are you doing!!" I was right next to the window and finally they stopped and the girl said " WHAT!!" I'm like "I need to get your drivers license number" and shes like "you should have gotten that earlier".

So I'm like well I forgot.... sorry. So I finally get it and they leave and I walk back to my car. ( I was on my way to Muay Thai kickboxing so I'm just wearing my shorts and a beater) So people who were around were watching this scene and probably thinking what the heck is going on. I get back to the car and right when I got back I saw the police man going through the parking lot. I kind of waved to him and he saw me, but he kept going proceding to the exit of the parking lot. I run up to him and say " excuse me sir? Are you here for the accident" Hes like well you had your back to me.

So he pulls up behind my car and ask me if I had her information. I said yes so he hands me a form to give to the insurance company. That was it... he didn't write a report. So he left and I got my car towed... back to my place. The whole thing was just a bad situation...

Sorry about the lengthy essay, just trying to explain the whole situation well so people can understand exactly what happened.

I've got a friend in Sugarland that can pick up the radiator if you decide to sell it, assuming it will fit my 99. I would also like the exhaust but I am not sure it will fit.

Welcome to houston. A friend of mine was in the left turn lane, stopped and waiting to turn into a parking lot. A dumb ass female pulled out to use the turn lane to merge into traffic and plowed right into the front of his '99. Same story, the cop gave him a form and left. Let me know when you part out... I'm interested in the radiator and the cat-back.

Is Texas a no-fault state or something? We got rear-ended in Dallas and that's all the cop did for us too was give us a form. No report, no nothing.

New York is a no-fault state and when my car was wrecked last summer the cop still filed an accident report. Someone was being lazy unless the laws are completely wacked.

Still talking with the insurance company and faxing receipts to them, but a little update. The other car is either stolen or not ensured.... which everything makes sense now as to why she was acting so sketchy. It should be another day or say before I have time to go through the pms and the car part stuff.

Also I was talknig to the insurance company about the whole cop thing and they said in Texas if no one was hurt, then they don't file a report usually and just give you a form.

A sore shoulder from a seatbelt will heal up okay, but if your neck is sore then I'd say you were hurt. After my sister's car got smashed at a stoplight, her neck was sore for about three months. Hope yours isn't as bad. But it's something you might mention to the insurance, and definitely go see a doc if it hurts after a few days.

As for the insurance company, you're not going to have a whole lot of luck getting them to fully reimburse you for the mods to your car if you only paid premiums based on the value of a stock Miata. If you had a stated value policy covering the additional cost of your turbo build then it would be a different situation. If they're really lowballing you, get the edmunds, KBB, NADA values of your car, and prices comparable cars sold for in your area, and you can at least work them up to what a nice stock car would be worth.

I think the probability of having your Miata smashed is inversely proportional to the elapsed time since last maintenance. My car was hit by an aimless old lady not 5 minutes after I had finished up at a club tech session at the local Mazda dealership.

I was in H-town for grad school from '99-'03 and have been to Sugarland several times. In addition to lazy cops, that area has a shit ton of uninsured drivers.

Man, I lived in Sugarland for almost 9 years...I was surprised when you said you live there because it's not very big. I now live in San Antonio but have family in Houston who could maybe pick up some stuff for me if you part it.

Ok guys, finally got done with insurance... I am getting $3,000 after buying the car back. It looks like I am selling the car as a whole to a friend. This really is the best thing for me to do, because I need a form of transportation right now and I do not have time to be coming home to Houston all the way from San Antonio to part out the car. It will be to difficult for me to do. Sorry to get yalls hopes up about the parts :sad2: ....
