Like I said - I thought he must have had priors - strikes.
But point is that it is illegal to tailgate. It is illegal to use brights within some distance behind or from oncoing.
The guy did flash lights that startled the woman and caused the accident.
California - well, prosecutors anywhere have a real knack for stretching an issue when they want. Truck can be deadly weapon in some circumstance and using - blasting bright light into rear window can be considered assault, especially when it startles someone into losing control and wreck and die.
I don't think "enforcing" is an acceptable defense for whatever "intent".
If someone is killed from someone violating a law the violator might just be charged with homicide. It happens.
