yeah, that's easy. he heard another loud as car and just assumed you were racing and wrote down a false speed. ask where he clocked you...

but be careful. your prosecutor is also your expert witness.

Yes I am definitely going to have to do my homework on this and know my **** when I go in.

Going to consult with a few attorneys and see what they say.

The court appointed a "public defendor" to my case, but I have a feeling its going to be some n00b lawyer that sucks at life.

Not here.

Edit: Officer wrote $100 on my ticket. They told me it was really $200. I said I'm paying $100! They laughed and said the officer can write $0 for all they care. Then I laughed and said. I've decided to do community service. 6 months to do 22 hours. HAHA.

When you are in court, make sure you have paid someone to stand beside you who is a member of the state bar of california. Your Judge will also be a member of the state bar of california, and he will appreciate that one of his colleagues is being paid; regardless of how ridiculous this ticket is.

Maybe so, but he wrote "dry, dark, heavy traffic" on the ticket. Written on the ticket at the time of the incident will likely trump your assessment of conditions after the fact.

$1900 is stupid money for a moving violation.

yeah he also wrote down 40/50, in which he didn't actually capture the speed. proove that and ticket cannot stand.

but it's your prosecutor's/witness's word against yours.

This is what I'm afraid of and why I'm looking for a good attorney.
The facts are there. I have nothing to hide. PROVING them when its his word against mine is a whole 'nother deal.

I heard that cop cars here in CA now all have cameras on them. I'm going to try the " show me the radar printout and camera feed as proof that you actually witnessed the speed contest" argument.

I know that around here the judges consider the cops to be 'trained' at estimating speed, so the fact that he wasn't using radar doesn't get you out of anything. Lawyers generally can make stuff go away before the court date arrives tho.

Yep, look up VASCAR. It's used around here frequently.

Said "I heard you guys down the block". That is why the speed he wrote down we were going is 50 in a 40. Really he didn't even see us or get us on radar, or really even know if it was us. We just HAPPENED to be the only 2 sporty/modded cars on the road and I guess it was easy to ASSUME it was us
he never saw em!

18 If it did go down the way you say it did, at least here in Florida, You'll walk. Officers can not estimate your speed. They would have to gun you and write a tracking number from the log on your ticket. Set that **** for court. Look up the statute he says you violated and work it.

not all police cars have cameras on them in CA. My Dad is a cop in Modesto, and once he got certified to carry a radar gun he was also trained in visually determining speed. Its not using VASCAR, its just looking at the vehicle and objects around the vehicle to make an educated guess.

Goes along the lines of reasonable doubt.
