They say that Bates believed he was holding his Taser and not his firearm when he fired the round that killed Harris.

Whatever Bates’s intentions, however, the other officers on the scene respond to Harris’s cries for help by forcefully pinning him to the ground and telling him to shut up in the video released by the sheriff’s department. As Harris lies face down on the ground bleeding and crying out “oh shit man, he shot me, he shot me! Oh, he shot me!” one officer puts his knee on Harris’s head in an apparent effort to subdue him. An officer tells Harris to “shut the fuck up” shortly thereafter.

When Harris tells one of the officers “I’m losing my breath,” the officer responds, “fuck your breath.”

Fairfax jail inmate in Taser death was shackled - The Washington Post


A mentally ill woman who died after a stun gun was used on her at the Fairfax County jail in February was restrained with handcuffs behind her back, leg shackles and a mask when a sheriff’s deputy shocked her four times, incident reports obtained by The Washington Post show.

Natasha McKenna initially cooperated with deputies, placed her hands through her cell door food slot and agreed to be handcuffed, the reports show. But McKenna, whose deteriorating mental state had caused Fairfax to seek help for her, then began trying to fight her way out of the cuffs, repeatedly screaming, “You promised you wouldn’t hurt me!” the reports show.

Then, six members of the Sheriff’s Emergency Response Team, dressed in white full-body biohazard suits and gas masks, arrived and placed a wildly struggling 130-pound McKenna into full restraints, their reports state. But when McKenna wouldn’t bend her knees so she could be placed into a wheeled restraint chair, a lieutenant delivered four 50,000-volt shocks from the Taser, enabling the other deputies to strap her into the chair, the reports show.

The account comes from dozens of pages of sheriff’s deputy incident reports that provide the first complete account of the events leading to the death of the 37-year-old Alexandria mother that has troubled her family and local mental health advocates.

Fairfax County Sheriff Stacey Kincaid declined to comment on the case but defended the use of a stun gun on a restrained prisoner, saying it was “a means that is often useful to ensure the safety of a person” rather than using physical force to gain compliance. She said stun guns were used “occasionally” on prisoners who are already restrained.

A family is mourning the horrific death of their daughter.

A cop forced their daughter, Ashley, down to the ground, pressed a 9mm handgun against the side of her head, and shot her to death, according to reports.

She was executed at point-blank range, as the bullet ripped through her brain tissue.

Ashley leaves behind her three young children and her parents.

It began when Ashley was at a party with Officer Thomas Fallis. At the time, Ashley had been married to Officer Fallis.

At some point during the party, Ashley told Officer Fallis that she was “going outside to have a smoke” with her female friends.

For reasons unknown, Officer Fallis suspected that Ashley was actually going outside to smoke marijuana, not a cigarette.

Officer Fallis took offense to this and became wildly enraged, accusing Ashley of smoking marijuana, according to reports.

Ashley’s family has also come out and specifically reported Officer Michael Yates for covering up the murder by purposely omitting key evidence from the investigation documents.

The chain of events, then, appears to have been brought about as follows: Officer Fallis murdered Ashley in cold-blood; he then tried to cover up the murder by claiming that Ashley shot herself; then he found additional help from Officer Yates, who suppressed critical evidence from the investigation.

Now, a grand jury has finally indicted Officer Fallis for the murder of Ashley, dashing his pathetic attempts to cover it up.

No details are forthcoming as to whether and to what extent Officer Yates will be charged.

Officer Fallis was brought in Tuesday morning and is being held at a county correction center in Bloomington, Indiana.

Police In New Mexico Will No Longer Seize Your Property Without Finding You Guilty Of A Crime


New Mexico Gov. Susana Martinez (R) on Friday signed a bill into law overhauling the state's civil asset forfeiture program, which had previously allowed police to permanently seize property without a conviction or charging the owner with a crime.

Set to go into effect in July, House Bill 560, passed last month with broad bipartisan support in the state legislature and signed by Martinez just before Friday's noon deadline, requires authorities to obtain a conviction or guilty plea before permanently seizing property. It also reforms incentives for civil asset forfeiture, channeling proceeds to the state's general fund rather than directly to police department coffers.

In her signing statement, Martinez said the bill will "improve the transparency and accountability of the forfeiture process and provide further protections to innocent property owners." But she also expressed concerns with the use of the term “policing for profit” -- popularized by critics of civil asset forfeiture -- calling it "an overused, oversimplified, and cynical term that, in my opinion, disrespects our law enforcement officers."

Texas Cops Arrest Teen for Watching Them Sans Camera in Parking Lot - PINAC


Texas cops arrested a teen for merely watching them Monday, accusing him of interfering with their investigation, forcing the 17-year-old to spend a night in jail and miss a day from school.

But footage from their own body cams shows that Dylan Waddle was nowhere near their investigation, which turned out to be nothing but other teens playing with toy guns anyway.

But in Springtown, population 3,000, that apparently is considered a top secret investigation.

Despite evidence from their own cameras showing Waddle broke no law, Springtown Police Chief Ed Crowdis told the local media that Waddle had come “to antagonize.”
But usually that’s the term reserved for citizens trying to record them, not just watch them.

Civil Forfeiture Reforms Stall -- For Now - NewsChannel5.com


On Tuesday, a bill to overhaul Tennessee's civil forfeiture laws ran into a police roadblock in the legislature.

But the House speaker says she's going to make sure the issue doesn't die.

It's an issue that had united the left and the right in calling for reforms.

But the sponsor of the bill, Rep. Timothy Hill, told NewsChannel 5 Investigates that he lost votes after some members of a key committee heard from family members who are in law enforcement and who do not want to give up a source of income.
