They actually do not. It'd be sufficient to prove that he knowingly possessed classified documents (which he's admitted to), or that he conspired to hide this fact from law enforcement (which he's on record as instructing his lawyers to do.)

Knowingly processing classified information which are you not authorized to hold violates subsection E of the act. Trump definitely did that.

Refusing to return classified information which you possess violates subsection D of the act. It appears that Trump did that as well.
