Deputy suspended after K9 officer dies in hot car | THV11.com


The handler of a Madison County K9 officer is facing disciplinary action after the K9 died from being left in a hot car.

K9 Officer Lina died September 9 after her handler, Deputy Jonathan Cornelison left her in a patrol car from 7 a.m. until 3 p.m.

Cornelison is suspended for 60 days without pay and removed from the K9 program.

The 5-year-old dog has been with the sheriff's office for three years and used mainly for drug investigations.

Cornelison will not face any criminal charges.

Miami-Dade Cop On Trial For Allegedly Stealing Gas Found Guilty « CBS Miami


A Miami-Dade police sergeant on trial for allegedly stealing gasoline has been found guilty on all six counts.

A Miami-Dade criminal court jury began hearing the fraud case against Emil Van Lugo last week.

Lugo is accused of organized fraud for allegedly repeatedly stealing gasoline from a county-owned pump and using it to gas up his wife’s BMW from January through March of last year.

Assistant State Attorney Trent Reichling told jurors that police received a tip in January 2015, that the 16-year veteran was filling gas cans with fuel at a county station miles from his home and far from the Hammocks district station where he gassed up his patrol car during the week.

Reichling said detectives videotaped the sergeant on five occasions, filling gas cans at the county station normally used to gas up waste management vehicles. They then watched him drive home, take the cans out of his car, place them in his garage and later emerge and fill up his wife’s BMW.

After a week-long trial, a prosecutor told jurors the videos don’t lie.

“He’s on video on all those days at that fuel site to steal,” said Assistant State Attorney Terry Livanos.

The state says records show Lugo got gas at the remote station on 50 consecutive weekends, while fueling up his cruiser during the week at the county location.

“This was planned. This was well thought out. This was a police officer methodically covering his tracks,” Livanos said. “He’s out there (at the county fuel site) like clockwork, weekend after weekend after weekend.”

Defense argued that the sergeant always first put the gas cans in his garage, and the state didn’t prove the fuel he later put in his wife’s BMW came from the county pump, that they could have been different gas cans.

Defense attorney David Edelstein argued the gas from the county pump was for the officer’s squad car.

“If he put the gas into the police car, that is not a crime what he did,” Edelstein told jurors.

The state said there is additional, damning circumstantial evidence: neither Lugo nor his wife used their credit cards to purchase gasoline until after he was arrested and suspended last year.

Lugo faces up to five years in prison and the loss of his law enforcement certificate for the organized fraud conviction. The other five counts are misdemeanor theft charges.

Lugo’s wife, Irene Gomez-Lugo, is a long-time Miami-Dade Schools employee, currently an assistant principal, on maternity leave with their newborn child. Both mother and baby have been in the courtroom.

Donna, TX - A school district security officer was arrested Tuesday in connection with a video of a fight in Donna High School that showed him slamming a 16-year-old female student against the ground several weeks ago, according to officials.

Michael Soto, 33, was booked into the Hidalgo County jail on official oppression and false report charges after Donna ISD police conducted an investigation and found evidence that the officer lied about what happened during the Sept. 16 fight.

Defense attorneys for Stafford and Greenhouse Jr. argue the deputies acted in self-defense and claim Christopher Few used his car as a “deadly weapon” at the time of the shooting.

Judge William Bennett also ruled the two deputies will have separate trials.

Georgia cop arrested after claiming black man shot her | WTSP.com


A Georgia police officer who allegedly made up a story about being shot by a suspect while on-duty has been arrested.

Jackson Police Officer Sherry Hall is facing multiple charges related to an incident on September 13. Hall originally claimed that she had been shot by a black male in Jackson, Ga.

However, after the Georgia Bureau of Investigation was asked to look into the incident, authorities said that they believed Hall made up the story.

The alleged incident happened in the early morning hours of September 13. Hall said on the radio call that she had been shot in the abdomen, and described a black male subject who was positioned near the wood line near a cul-de-sac on Camelia Court in Jackson. Hall indicated that she did not use her car's video and audio recording equipment.

As part of their investigation, the GBI looked at evidence from the hard drive of the in-car camera system, as well as engaging the assistance of a GBI Digital Forensic Investigator in an effort to recover additional evidence. Inconsistencies were uncovered in relation to Hall's story, which led to the conclusion that she was, in fact, not the victim of a shooting.

In an effort to reconcile the in consistencies, the GBI conducted a subsequent interview of Hall, and during that interview she stopped cooperating with the investigation.

Further investigation determined that Hall failed to reveal to the GBI that she was in possession of an additional department handgun issued to her on July 1, 2016. After a search warrant was issued for her Butts County residence, the weapon was seized.

Hall had been located at a private facility, and upon her release on Monday, she surrendered of her own volition for arrest, processing and booking at the Butts County Detention Facility. She has been charged with False Statements, Tampering with Evidence, Interference with Government Property and Violation of Oath of Office.

Cop Handcuffs then Tasers Mentally Disabled High School Student for Being Tardy


Police violence against young black men is not confined to the streets, a high school student says in a lawsuit claiming a school police officer Tasered him twice for being late to class after having an anxiety attack.

Tyson Reed and his mother, Linda Reed, sued Kern High School District, KHSD Officer Luis Pena, and teacher Brett Bonetti on Sept. 22 in Kern County Superior Court, alleging disability discrimination and civil rights violations.

“Schools are supposed to be safe places for kids,” the Reeds’ Los Angeles-based attorney Shawna Parks told Courthouse News. “This case demonstrates how quickly it can go horribly wrong when schools don’t follow proper protocol” for students with disabilities.

Parks said Reed was attacked primarily because of his disability, but his race was likely a “determining factor” as well.

“Talk about the quickest way to shut down a kid’s interest in learning,” she said. “It’s not the kind of atmosphere you want in a school.”

Kern High School District spokeswoman Lisa Krch said in an email that the school disputes Reed’s version of events.

“The district will steadfastly defend itself in this litigation and awaits the opportunity to provide accurate information and factual context to this incident and about the conduct of the parties involved,” Krch wrote.

Reed, now 18, played varsity football at Bakersfield High School, from which he graduated in June. He was diagnosed with an anxiety disorder during his junior year

Things came to a head in early March 2015, when Reed was called to the dean’s office about an incident in an earlier class. The dean soon realized Reed was not involved and gave him a pass to his seventh period class, which already had started.

Reed says the conversation left him anxious, so he drank some water, walked to the bleachers and listened to music to calm down. After his anxiety subsided he went to class, handed Bonetti the pass from the dean, and sat down at his desk.

Despite knowing of Reed’s disability, Bonetti ordered him to collect his things and go to the front office for being tardy. Reed “calmly” asked Bonetti to mark him present, which Bonetti refused to do, according to the complaint.

Instead, Bonetti called campus security. Reed says he was still sitting at his desk after the bell rang to end class, explaining the situation to the security guard, when defendant Pena arrived.

“When Officer Pena arrived, he walked in, pushed Tyson’s desk away and yelled at Tyson. He then grabbed Tyson by the arm and Tased him. At some point, the security guard grabbed Tyson’s other arm. Tyson fell and/or was thrown to the ground, cutting his lip on his braces. Officer Pena then began to handcuff Tyson. However, he Tased Tyson again after putting handcuffs on him while Tyson was down on the ground. During this time Tyson was screaming in pain, yelling ‘I don’t deserve this!’ or words to that effect,” the complaint states.

Pena then “marched” Reed through the hallways in front of other students to his patrol car. After taking Reed to the hospital, Pena booked him into juvenile hall, where he was later released to his mom, according to the complaint.

The school suspended Reed, but ultimately rescinded the suspension and wiped it from his record. It held a meeting to discuss accommodations for Reed the Monday after the incident, which was too little, too late, the Reeds say.

Pena made matters worse by filing false delinquency reports against Reed, who spent 10 months in court before the delinquency judge dismissed the allegations against him, according to the complaint.

Though he was ultimately vindicated, Reed says, the events left him and his mother “irrevocably scarred.” He felt so humiliated that he went on independent study for the last semester of his senior year because seeing the people who were involved and the students who witnessed his arrest was too much for him to handle.

The Reeds seek an order finding that the defendants broke the law, and punitive damages against Bonetti and Pena.

Police called in over an apparently mentally ill homeless man who allegedly wielded a knife in front of spooked resident tried to run the man over with their vehicle before fatally shooting him. Police released video from three dash cams as well as 911 recordings related to the July incident late last month within an hour of the Sacramento Bee releasing footage taken by a witness of the shooting itself.

In one of the recordings, one of the officers is heard saying "fuck this guy" and suggesting he would try to run the man over. The second cop agrees. A little over thirty seconds later, the cops fire at the man 14 times, killing him. Police were originally called because the man, Joseph Mann, was allegedly staring at residents who were having coffee outside in a way that made them uncomfortable, as the Sacramento Beereports. Residents say Mann then began to pretend he was typing on an imaginary keyboard and urinated his pants. Residents say they told him he had to leave. Mann responded by pulling out a knife described as a steak knife, and then residents called police. The resident who called told police Mann had a knife and also suggested he may have had a gun, saying he had seen Mann reach for something in his waistband he said "looked like a gun." Dispatchers told police Mann was armed with a knife and a gun, but a gun does not appear on the footage nor did police find one after canvassing the area.

The incident, which happened days after high profile police shootings in Baton Rouge and Minnesota and the ambush on police officers in Dallas, led members of the Sacramento city council to demand to see the footage, but the city attorney advised them to wait until the investigation was over. Police released the footage only after the Sacramento Bee released footage taken by a witness. The two cops were placed on "modified duty" after the incident.

Long Beach officers together when baby died are identified as investigation continues | SunHerald


Hancock County investigators on Monday identified the two police officers on leave pending the outcome of an investigation into the death of a 3-year-old daughter of one of the officers.

Long Beach police officer Cassie Barker has been identified as the mother of Cheyenn Hyer, who died Friday after she was left unattended in a patrol car on Standard-Dedeaux Road in Kiln. Sheriff Ricky Adam said the car was running and the air conditioning was on when sheriff’s investigators got to the scene between noon and 1 p.m. Friday.

However, Adam said, the case remains under investigation and an arrest could follow once investigators receive additional information requested from other officials.

Hancock County Chief Deputy Don Bass said that Cheyenn was left in the patrol car for four hours while Barker “was visiting” with Long Beach patrolman Clark Ladner.

Bass said Ladner did not know Cheyenn was in the car while Ladner and Barker were inside.

Chief Investigator Glen Grannan said Monday deputies have learned Barker was involved in an unrelated incident which resulted in her having to go through the state Department of Human Services “so she could have her child back.” The incident involved the same child.

Grannan said investigators are “going through the proper legal protocols to get all the information I need.”

Long Beach Police Chief Wayne McDowell said Barker and Ladner are on administrative leave with pay pending the outcome of an independent investigation into the incident. Barker and Ladner were together, but off duty at the time the child was found. They were not in Long Beach.

Hancock County Coroner Jim Faulk said the preliminary results of the child’s autopsy at the Mississippi Forensic Laboratory in Pearl should be available early this week.

McDowell described the incident as “sad.”

“I’ve spoken with the male officer involved, but I’ve not spoken with the female officer, not as far as the official internal investigation, because of medical reasons,” McDowell said. “The mother is in shock. I will talk to her soon.”

The child was pronounced dead at Hancock Medical Center.

Temperatures Friday were in the high 80s to low 90s, with the heat index reaching above 100 degrees.

Dashcam audio captures two California cops discussing how to kill fleeing black suspect | The Japan Times


The dashcam audio-video tape surfaced around the time of two other fatal police shootings of black men in California — one in the San Diego suburb of El Cajon last Tuesday and one in Los Angeles on Saturday — that triggered a weekend of protests in both communities.

Burris, who has already filed a civil rights lawsuit over the Mann shooting, said he also sent a letter to U.S. Attorney General Loretta Lynch calling for a federal probe of the case.

In the dashcam video obtained by the Sacramento Bee newspaper, which enhanced the audio, the patrol car can be seen driving toward Mann as he fled on foot. One officer is heard saying, “I’m going to hit him,” and the partner responds, “Go for it.”

The video twice shows the patrol car veering toward Mann, who appears to run to dodge the vehicle.

Out of full view of the camera, the two policemen, John Tennis and Randy Lazoya, exit the vehicle before fatally shooting Mann, Sacramento City Attorney Jim Sanchez said in a phone interview.

Burris said the two officers are white, but Sanchez declined to give their race.

The Sacramento County district attorney is conducting a criminal review of the shooting.

A whopping 54,500 people were killed or hospitalized by cops in a single year compared to approximately 14,000 deaths caused by overdosing on heroin, cocaine and methamphetamine combined. Judging from this astounding comparison one can determine it is much safer to snort coke, inject smack, and smoke crystal than it is to be searched or arrested by an American cop.

A new study published in a British Medical Journal specified, in 2012, U.S. police killed or seriously injured 54,500 people during arrest or search situations. The international peer-reviewed journal for health professionals cites,

“On average, an estimated 1 in 291 stops/arrests resulted in hospital-treated injury or death of a suspect or bystander.”

Saginaw County Sheriff Denies Driving Seized Muscle Car, Won't Explain 56k New Miles


The Saginaw County Sheriff’s Department has yet to explain how 56,000 miles were added to the odometer of a classic muscle car that it seized and held for over a year before selling it. The county also denied a Freedom of Information Act request for more documents regarding the vehicle following a previous article detailing the civil asset forfeiture case.

On Sept. 13, it was reported that 56,000 miles had been added to a 1965 Chevy Nova SS, which was owned by Shiawassee County couple Gerald and Royetta Ostipow, while it was in the possession of the department. Information in the report came from a seizure-related form from the department as well as a title transfer document.

A day later, Saginaw County Sheriff William Federspiel went on theFrank Beckmann Show and said allegations were not fact-based, citing the same title documents.

She was arrested and charged with a crime she didn't commit. The case was headed to trial, until her attorney got ahold of the body camera footage.

The woman, who did not want to be identified, was arrested by DC Police for having an open container of alcohol. She says, she was wrongfully arrested. But when it's a classic case of he said, she said, how do you prove it? Her attorney had an idea.

We've seen the importance of body camera footage, it's usually a life-and-death situation, such as a police-involved shooting. But what about an open container arrest? "An average run of the mill case," said George Lyon, the attorney.

Lyon said his client was arrested in the Trinidad neighborhood in NE DC in August. Police said the can of beer and a bottle of tequila they found on the sidewalk belonged to Lyon's client.

"My client said she was not guilty," says Lyon.

Not only that: She said she was arrested for doing something that wasn't illegal at all; getting an attitude with the officer.

"So I asked her, were the officers wearing body cameras? She said yes," says Lyon.

Lyon requested the video from her arrest, and the evidence was there. On the tape, you can hear the officer saying, "You got an attitude? OK, you can come with us, too."

"People have the right to have an attitude and not get arrested," said Lyon.

The video further proved her innocence, when it was clear the alcohol in question was nowhere near his client.

"She couldn't even get to it," said Lyon. "It wasn't within her car."

Which means, she should never have been arrested in the first place. In the end, the prosecution dropped the charges.

Lyon said more and more attorneys are requesting body camera footage for their clients. Lyon also said as more officers wear body cameras, the number of complaints against police officers has gone down, effectively keeping everyone involved honest.

We reached out to DC Police for a comment on this story and have not heard back. DC Police are now required to confirm with dispatchers that their body cameras are on. More than 1,000 DC Officers wear body cameras now.

Police Officer Pleads Guilty to Enslaving Teen Wife As Prostitute - Counter Current News


A former Baltimore Police officer just pleaded guilty to prostituting his 19-year-old wife as well as another teenager who was living with them.

Lamin Manneh, 32, of Baltimore forced the two teens into prostitution, according to prosecutors. The sex-slavery occurred between February 2013 and May 2013, and garnered more than 300 customers.

Manneh admitted to traveling across state lines in his plea, as well as using a telephone and Internet in the operation of a prostitution business.

He now faces up to five years in prison.

Two Albuquerque cops charged with the second-degree murder of a homeless man suffering schizophrenia — whose only crime had been illegally camping — have now been let off the hook for the killing after a hung jury left a judge no choice but to declare a mistrial.

Retired Officer Keith Sandy and Officer Dominique Perez had been charged for the murder of 38-year-old James Boyd in August last year — after Albuquerque police cleared them of wrongdoing — in a rare case where cops were forced to face legal responsibility for a highly questionable and brutal killing.

A mistrial was declared by Judge Alisa Hadfield on Tuesday when only three of twelve jurors voted to convict the two officers — which, though deplorably typical, seems inexplicable given officer helmet-camera footage and several nasty details in the case.

On July 25, 2016 Amanda Houghton called police for help after she was rear-ended at a stoplight. She expected Layton City officers would help her, but instead she was arrested for DUI and subjected to a body search that left her feeling violated. The arrest was recorded by a police camera.

“I was shocked. Who arrests a sober person for DUI?” she said.

She failed a field sobriety test but says it was because she was shaken after being hit at about 30 miles per hour. Her car was totaled after the crash.

Houghton is also upset that after she was put in handcuffs, the officer searched around her breasts to check for drugs or weapons.

She is now pursuing legal action against the city of Layton. At the same time, has to worry about the DUI and resisting arrest charges that have not been dropped, despite the fact that blood tests -- one done by police, the other by the hospital -- showed she had no drugs or alcohol in her system.

Her criminal defense attorney, Jonathan Nish, said he filed a request for the court to throw out the DUI charge.

“I don’t’ believe they should have administered the field sobriety tests at all in this case,” he said.

Houghton has also hired attorney Robert Sykes who has put the City of Layton on notice that they are seeking legal action.

Sykes said the officer had no basis for suspecting she was under the influence and the search of her person was unconstitutional.

“I think this amounted to an unconstitutional search of a woman without a necessity to do so,” he said.

Layton police disagree.

A police report by officer G Schatzman indicates Amanda exhibited odd behavior and gave “short quick answers to questions and she was speaking rapidly. Amanda was unable to stand still and seemed to be making jerky movements,” when he came into contact with her.

During the field sobriety test, she didn’t pass and showed physical clues that she was under the influence.

Lt. Travis Lyman said his officer did the arrest by the book and had reasonable suspicion that Amanda was DUI.

He said the search around her breasts is taught in the police academy. Male officers do it when a female officer is not around.

“That’s standard practice. Anytime someone gets arrested they are going to be searched,” he said.

Lyman confirmed the blood tests showed Amanda had no drugs or alcohol in her system but said it’s up to prosecutors and the judge to determine if the charges will be dropped.

Arrests for possessing small amounts of marijuana exceeded those for all violent crimes last year, a new study has found, even as social attitudes toward the drug have changed and a number of cities and states have legalized its use or decriminalized small quantities.

And a disproportionate number of those arrested are African-Americans, who smoke marijuana at rates similar to whites but are arrested and prosecuted far more often for having small amounts for personal use, according to the study. The arrests can overwhelm court systems.

Dianne Jones, 45, who was arrested in New Orleans in 2014 on charges of having a small bag of marijuana, spent 10 days in jail because she could not put up a $2,500 bond. She was able to get enough money together only after her daughter sold the family’s television set at a pawnshop for $200.


Later, when Ms. Jones, who is African-American, was unable to pay court-ordered fees and fines, a judge issued a warrant for her arrest.

With marijuana use on the rise, law enforcement agencies made 574,641 arrests last year for small quantities of the drug intended for personal use, according to the report, which was released Wednesday by the American Civil Liberties Union and Human Rights Watch. The marijuana arrests were about 13.6 percent more than the 505,681 arrests made for all violent crimes, including murder, rape and serious assaults.

The report comes in the wake of the fatal police shooting of Keith Lamont Scott last month in Charlotte, N.C. Mr. Scott, 43, had attracted police attention in part because, the police said, he was smoking marijuana.

Tanis Ukena rarely left his Layton neighborhood or even his home for about two months.

"It's scary to go out in public when you're receiving death threats and stuff online," he told reporters Tuesday.

Ukena, 18, quickly became a target of scathing ridicule on social media from people across the nation when Layton police arrested him in August, accusing him of lacing an officer's drink with THC.

On Tuesday, Layton police said Ukena will not be charged after test results came back negative for illegal substances.

Police initially claimed a surveillance video from the Subway where Ukena worked showed the incident unfold Aug. 8 when the officer used the drive-thru at the restaurant, 1142 E. state Route 193. The officer became seriously ill after consuming part of a drink and eating some of a sandwich.

Ukena said he and his co-workers, knowing none of them would poison a police officer, cooperated with law enforcement as they examined the restaurant "for an hour or two." He said he was stunned when police arrested him and booked him into jail.

In May 2015, officer Daniel Aguirre was given a Combat Cross Medal after he said in a police report that he successfully fended off a struggle in which he and his partner were in danger. However, someone on the inside leaked Dashcam footage showing Aquirre shooting a man in the back as he lay prostrate on his hands and knees. Still, Birmingham police charged their victim, Aubrey Williams, with attempted murder.

But, last week, after spending more than a year in jail for a crime he never committed, the Jefferson County District Attorney’s Office finally showed a semblance of logic and dropped the charges against Williams.

“After an extensive review of all the evidence in this case, the state is unable to meet the burden of proof beyond a reasonable doubt,” according to the press release issued by the Jefferson County District Attorney’s office late Friday.

“This man stayed in jail for more than a year and a half on some trumped up charges by these Birmingham police officers,” Anthony said. “Not all police officers are bad, but when they make a mistake they should own up to it,” he said, according to AL.com.

According to the entirely fabricated police report, Aguirre began to struggle with a man named Aubrey Williams who pulled a gun and pointed it at his partner officer Richard Haluska. When he ordered the man to drop his gun, the suspect then pointed his gun at Aguirre. Aguirre fired and struck the suspect.

Williams wasn’t pointing the gun at anyone, and the department had to have known this, but they gave Aguirre the award anyway.

The dashcam was leaked to AL.com from a confidential source inside the department. After it had been posted on their website, the department had no choice but to issue a statement saying they are taking back the award.

“In regards to the officer involved shooting that took place on April 24, 2014, the award is rescinded until further review by the Awards Committee,” said Officer Lt. Sean Edwards at 10:57 p.m. last November.

I've decided I'm not going to mess with it. Even though I was illegally arrested then released before they booked me, I know nothing will happen so I don't see the point of continuing to stir their ire with me.

Thankfully the Sgt wasn't a moron (like his 2 officers) and when he showed up told them to release because where I live cops aren't allowed to arrest you for a misdeanor they didn't physically see you commit. Aside from the fact that I didn't commit it.

But being dragged out of your house, not allowed to put shoes on, then watch them go inside and look around while you're in the back of the car cuffed, was more than disconcerting to say the least.

I'm sure them settling is worth far more to them than facing the embarrassment that actually going public with everything would bring. The DA would jump on a chance to bury this forever because it doesn't really make the officers look all that good at their jobs and all.

I got some more information from my roommate last night (he works off hours so I don't see him much) that makes them look even worse.

I have family in the Federal DAs office in this county and other family that are LEOs in other parts of the state. It may warrant further discussion.

I pulled a car over last night for texting and driving. When I went to talk to the driver, I found a young black male, who was looking at me like he was absolutely terrified with his hands up.

He said, "What do you want me to do officer?" His voice was quivering. He was genuinely scared.

I just looked at him for a moment, because what I was seeing made me sad. I said, "I just don't want you to get hurt."

In which he replied, with his voice still shaking, "Do you want me to get out of the car."

I said, "No, I don't want you to text and drive. I don't want you to get in a wreck. I want your mom to always have her baby boy. I want you to grow up and be somebody. I don't even want to write you a ticket. Just please pay attention, and put the phone down. I just don't want you to get hurt."

I truly don't even care who's fault it is that young man was so scared to have a police officer at his window. Blame the media, blame bad cops, blame protestors, or Colin Kaepernick if you want. It doesn't matter to me who's to blame. I just wish somebody would fix it.

A Maryland cop searching for a shooting suspect described only as a “black man with a hoodie and jeans” ended up pouncing on a black man with a hoodie and jeans walking down the street, slamming him to the ground and handcuffing him while another officer punched him in the face.

Turns out, the man was an off-duty cop.

Now Washington D.C. police officer Robert Parker Jr., 28, is claiming racial profiling.

However, the Prince George’s County police officer who accosted him is also black, if that makes any difference. The officer who punched him is white.

Meanwhile, the actual shooting suspect, Nicco Rashaad Young, 20, is still at large.

The incident took place Tuesday in the parking lot of Iverson Mall in Temple Hills when the gunman shot another man several times in the stomach over an argument.

The gunman then took off running as the victim managed to survive.

Parker, wearing a jacket over his hoodie, had just dropped his car off at the repair shop and was walking down the street about three blocks away when the Prince George’s County cop pulled up alongside him.

Parker, whose father spent 30 years as a Washington D.C. cop before retiring, has hired an attorney and plans to file a formal complaint.

Sandusky Register: Bolton found guilty of excessive force


In a local landmark case, a jury found embattled Vermilion police Officer Aaron Bolton guilty of misdemeanor assault.

The conviction stems from a problematic September 2015 arrest, when Bolton slammed a handcuffed man’s head against a police cruiser’s door.

Erie County Common Pleas Court Judge Tygh Tone scheduled a sentencing hearing for Dec. 12. Bolton faces up to six months behind bars and a maximum $1,000 fine.

Jurors, however, found Bolton not guilty of two other crimes: assault, a second-degree felony; and aggravated assault, a fourth-degree felony. The latter charge was added later on in this case.

Police body cam footage, recording the incident, showed Bolton manhandling the defenseless suspect. The surveillance footage, however, didn’t fully capture Bolton punching this person in question, likely resulting in “not guilty” verdicts.

Erie County prosecutor Kevin Baxter — who said this is the area’s first such excessive force case involving a sworn law enforcement official he can remember since taking office in 1989 — seemed happy with the outcome.

“I think it was appropriate,” Baxter said. “There is certainly room for some reasonable doubt as to whether or not the police officer was justified in using that kind of force.”

He continued: “But the assault was clear. What he did at the car door, which was caught more fully and completely by a body camera, there is no excuse for that. It was excessive and clearly unjustified.”

Disgraced former Suffolk County Police Chief James Burke is begging a federal judge to sentence him to probation so he can care for his cancer-stricken mother.

Burke, 52, pleaded guilty last February to orchestrating a cover-up of the beatdown he gave a junkie, Christopher Loeb, who had broken into his car, stealing sex toys and other personal items in 2012.

A letter from Burke to Long Island Federal Judge Leonard Wexler is at the top of a list of 87 requests to the judge for mercy from the retired chief's family, friends, retired detectives from the NYPD and Suffolk police, and the father of Navy Seal and Medal of Honor awardee Michael Murphy.

Burke, never married and no children, had been the primary caretaker of his mother Frances, 75, who is suffering from Stage IV lung cancer. He faces up to 51 months in prison when he is sentenced next week, but is hoping the judge will give him time served — he's been held without bail for 11 months since his arrest.

"It would be unbearable for me to be in prison as her condition deteriorated and she passes from this earth," he wrote. "She does not deserve the consequences of dying while her oldest son, who has generally done good things most of his life, is in prison."
