After recent legislative changes, prosecutors and police in Kane County, Illinois have ramped up their automobile seizure program. As many as five vehicles a week are being taken under new guidelines allowing confiscation from anyone accused of driving under the influence of alcohol and a secondary offense such as not bringing along a driver's license. Even if the motorist is later found not guilty of both charges in a court of law, police in the Chicago suburb can still keep the vehicle.

"Now we're going after everything, whether it's a small amount of money or a large amount of money," Kane County State's Attorney John Barsanti told the Aurora Beacon News. "We're expecting this to get really big for us."

The program uses civil procedures to seize property from motorists even when they are found innocent. The civil court system only needs probable cause supported by circumstantial evidence to sidestep constitutional protections such as the prohibition on excessive fines and double jeopardy.

One rich guy with one good laywer and that will end. No conscious judge will allow people to be punished for crimes they are found not guilty of.

they are trying to pass a law here for motorcycles that you go to jail and lose you bike if you are going 30mph over the speed limit, its pure BS

at least they wait until you break a law for that one... the one the OP is talking about is straight up theft.

so if someone claims you where drunk the night before and your debt card shows you where at a bar that night they can take your car......thats so cool.....and if your proven innocent they still get to keep your car.....WTF? seriously how can anyone take that seriously...and I thought California was bad....jeesh

exactly......i mean anyone could be drunk driving under that pretense....shoot might as well just give everyone a "pre" drunk driving ticket in that case. punish them before because there gonna do sometime right?......
I mean why mask this under good pretense..just crank up the taxs...and California is good for some things......

(excluding the fire season......its like a nuclear winter outside right now :( )

You nailed it. They'll get away with it for a short time and it'll backfire. They're using civil preponderance of evidence laws against the motorists.
