If she's staying there after you move out, make absolutely sure all the services you pay for get canceled before the move. Cable, internet, power, water, whatever bills have your name on them. If those don't get canceled she probably won't pay them, and that will fuck your credit. Also make sure you proactively change your address with any credit cards, banks, etc. Don't just depend on the USPS to forward your statements; they occasionally miss one or two.

Well, we finally got the lease changed over today. I am officially an occupant. I guess that could end up fucking me if she wanted to. But whatever, I couldn't do anything with a new lease unless I knew this one was no longer in my name. Hopefully this new place will be open monday so I can drop off my app. and deposit.

Okay. Today I got the apps turned in and everything paid for. Now I'm just waiting on a reply on being accepted and what not. I've started moving shit out of the house to my mom's as a temporary way to keep her out of my stuff.

Now we come to the whole car thing. What are my legal rights here? I own the car, title in my name. When I move a couple weeks from now, I can simply just take it right? One issue though is the key. It's an 01 so it has one of those electronic keys and there is only one of them. I already have copies for that key but not in an electronic form. I was thinking about just taking out the starter and fuel pump relays the night before.

Under that situation, yes. If she takes off with it then it is a stolen car situation. Prior though, I can't have the police force her to give me the keys. That's a Justice of the Peace matter. Hopefully she'll go easy. Last night she called me and said she put new floor mats in it and clean it out for me. So hopefully that means she is planning on surrending the keys when the time comes.

I really think that it is going to go smoothly. Neither wants a fight. She knows it's yours and you will get it back with no problems. I wouldn't sweat it. She is likely feeling a bit guilty and will make it easy on you to make a clean break. It also makes it easier on her as well.

I guess the reason I'm a little anxious about the situation is because I know she isn't going to take the necessary steps to getting herself into a new car between now and then. That is definitely not my problem but it could become my problem since she is still driving my car.

I hate to bring this up, but if she totals the car just to hurt you do you have full coverage?

I mean, you already said you removed your belongings to safeguard them. Were they more costly than the car?

And if I was using you for the car, I would make nice and buy floor mats to buy myself another week, too. -Devil's Advocate

Play dirty and tell her you are changing the oil or the belts or even cut the power steering belt and get the key from her under the guise of getting it fixed and haul ass with it and lock it up at your parent's place for safekeeping. Tell her its got a bad PS pump and it's at the dealership because of some recall and they had to order the pump and because its backordered you don't know how soon it'll be back.

This is a business transaction now. Be smart about your assets and liabilities.

Hell, it doesn't even matter if she suspects you are lying about it. She's lying already.

I hate it for you. I don't even like to share my racing helmet with another dude.
