Oklahoma: Man Fights Back Against Speed Trap Harassment

The internal investigation determined that Goad's allegations were true, but it cleared Sugrue since he apologized. He was given a verbal warning, but the feud did not end. On February 16, 2013, Sugrue pulled over Goad, accusing him of driving 45 MPH in a 35 MPH zone. Goad challenged the ticket in court, requesting a copy of Sugrue's personnel file as part of the case on March 6. On March 7, Sugrue ran a background check on Goad with the FBI's National Crime Information Center, and arrested Goad for the felony offense of "making a false declaration to law enforcement" in the complaint Goad had made against Sugrue.

At issue was Goad's statement that he owned the pawn shop, something he could not do as because, Sugrue claimed, Goad had a past felony conviction. The charges did not hold, and both the speeding ticket and "false declaration" charges were dropped last August. Goad fired back by filing suit in the US District Court for the Western District of Oklahoma claiming his rights were being violated.

"Mr. Goad was exercising his constitutional right to free speech when he posted the speed trap warning sign on the property," Goad's attorney, Jack S. Dawson, wrote. "The unfounded speeding ticket and untruthful application for warrant of arrest coupled with the facts alleged herein establish actual vindictiveness, or alternatively, give rise to the presumption of vindictiveness on the part of defendants."

The suit seeks compensation for the official harassment.

A day after Miami’s police chief banned officers from carrying guns into City Hall, the police union fired back, challenging the rule as a violation of federal law and officers’ rights.

The Fraternal Order of Police’s attorney fired off an email to city officials Wednesday challenging the new rule that bans all officers, whether on duty or off, from carrying their guns into city commission or board meetings unless they are responding to a call or assigned to City Hall.

The union is demanding to bargain over the new rule and how it’s carried out.

Union members believe the policy is retaliation for a February protest at City Hall during which officers flooded the commission chambers demanding that cuts to their benefits be restored.

Miami Mayor Tomás Regalado and Police Chief Manuel Orosa said during the unruly protest that people in the audience, including city employees, feared for their safety.

Gun-mounted flashlights spark concerns in wake of accidental Denver police shootings - The Denver Post

Denver's police chief said Thursday he has ordered extra training and a review of department policies after the second accidental shooting by an officer this month and the fifth in a little over a year.

Police are still investigating the latest shooting Sunday night, but at least two of the accidental shootings have been blamed on gun-mounted tactical flashlights. Such lights have also been cited in other accidental police shootings across the country, including one that killed a man in Texas.

Police Chief Robert White said he is reviewing the use of all such flashlights and will likely require officers who use them to undergo added training. He has already banned officers from using a specific design of such flashlights.

I'm trying to figure out how you can go to court for one charge, but then a judge can go ahead and charge, prosecute, and find you guilty of an entirely new "crime" all at once.
I've heard folks complain about "legislating from the bench" but this takes it to another level.
Makes a bit of a dictator, unencumbered by the Constitution, of the judge. So he made a law by decree but needs to put his victim through a legal process to rectify the error.

My mom told me that she had to be alert when I was a toddler in high chair. She said that I would finish my drink then say "Sorry momie" then shove the glass off onto the floor.
Maybe observation had taught me, at very young age, that one could do just anything as long as they apologized. So I just did it all at once.
I tried to teach my ex's kid that apologizing a lot tended to thin the sincerity.

Screaming an apology puts sincerity in doubt - but that is another issue and OT.

Okay - pushing a cop hand off of ones self is assault on an officer and obstructing.
When the cop comes along he needs things done a certain way. That certain way is other men, citizens, must comply with absolute obedience to his commands.
It didn't seem much of a chase that the woman was approaching her husband when the cop drove up.
The guy had turned and was leaning like he was going to get down when the cop jump him and take him down.
The police state seems out to retrain humans to not act human. But when the cop FU then it is excusable human error.

Terrible business. What is a guy to do when he fears his own bodyguards?
Something got lost along the way when the masters fear the servants who were meant to protect and serve.

But I think of a lot of historical stuff and it seems that it has always been that the police are to keep the rabble in line while others blow air about ideals of the government made to serve man rather than mans purpose is to serve government.


Why the thread name change? Ready to kill would seem a subgroup of out of control.

It records MacKenzie having a 14-minute discussion in chambers with Corr, Walled Lake police, and an Oakland County assistant prosecutor. At various times, the judge can be heard telling Corr to get Stanley to agree not to sue in exchange for his freedom.

“Give up the civil suit,” MacKenzie can be heard saying to Corr. “Give up the civil suit. Give up the civil suit and I can get you something decent.”

Later on the recording, MacKenzie said he wants the suit dropped to spare the police and city of Walled Lake the “hassle” and expense of a lawsuit, and offers to release Stanley from jail that day if he’ll agree. He consults with Walled Lake Police Detective Paul Schneider and Wixom Police Sgt. Shannon Luther, who were present in his chambers.

“This guy gave you trouble, right?” MacKenzie asks Schneider, referring to Stanley.

“Right,” Schneider said.

MacKenzie tells Corr, “The issue is whether they are going to go through the hassle of it, and whether the city of Walled Lake is going to have to put up with the cost of the attorney.

“The offer on the table is, if he agrees that he’s not going to sue the police department over the R&O, (resisting and obstructing) they are willing to dismiss the R&O. I think that’s a quite a good offer.”

At the time of the recording, Stanley was serving 93 days for violating probation.

“He can get out today,” MacKenzie says on tape.

Stanley and Corr refused the deal and Stanley remained jailed three more weeks.

The Free Press provided MacKenzie with a transcript of the recording.

MacKenzie would not answer questions attempting to reconcile his previous denials with the contents of the tape.

Yup - that was definitely a high point.
Lucky for him there was not a whole crew. I have thought that the larger the number the more likely there tend to be a berserker present. When that one goes off the pack follows suit and will sometimes just fall over each other trying to get their lick in.

Kansas could make it a felony to report unfounded allegations of police abuse

Gonna make it illegal to complain in Kansas?
And even if one is not prosecuted for complaining one may well be persecuted.

James Kuehnlein: Cop Fired For Controversial Recording Gets Probation For Domestic Assault

In 2007, James Kuehnlein, then a St. George police officer, made headlines after his bosses fired him over comments he made, caught on tape, taunting a driver. He reportedly said, "You want to try me? You want to try me tonight? You think you've had a bad night? I will ruin your ****ing night."

He went on, however, to work as a sergeant for the Velda City Police Department, where he eventually lost his job again over more serious charges: He had allegedly assaulted his girlfriend, pulling out a handful of her hair and more, leaving her with a minor concussion and injuries to her face and throat.

LOS ANGELES, CA -- After stopping a car "because we have a lot of problems with fraud rental cars here," a female officer threatened to illegally pull a man out of his car and illegally search it, when the citizen asked a simple question: "I being detained or I'm free to go?"

"I'm asking you a question but you can be pulled you out of the car and I can search it if you really want," says the officer.

"Um, how is that?" asks the citizen.

"Any way I want. Doesn't mean I can use what I find, but I can do it. So you wanna do that? You wanna play that game? You little hardass?"
