Default $380 chargeback! WTF!?

Ok so I'm looking for some advice. Hopefully someone here has hands on experience with what I'm supposed to do now.

My Verizon contract was up for renewal and they offered me phones at a discount price. I work construction and don't have the need for a phone better than my razor. So I did some research on ebay to see what these newer phones go for and saw an opportunity.

Bought a LG voyager for $39 and listed it on ebay. Within 1 hour of listing it I sold it for my $275 BIN. Shipped the phone, and I thought that was the end of the story.

Today I get a text saying I have until 07/09 to activate the phone to avoid a $380 chargeback! WTF does this mean? Does that mean they want ME to activate it under my #? Or does the guy I sold it to simply need to activate it?

hahahah, same thing happened to me. luckily they never went through, i think the person who bought it, once activating it, made things kosher with verizon. that was in Dec.

You were supposed to activate the phone first, then put service back on the old phone, THEN sell it.

They did the same thing to me on a replacement handset we didn't want last year.

They never sent me a return package, and just when I was about to list it and make some money, they plopped $400 onto my bill, somehow considered it past due, and interupted service. Damn I was pissed, I had only called them 10 times asking for the padded return envelope.

Phone companies are the devil.

****. lol

I see, so I should have activated the new phone, and then back on to my phone. I guess maybe I'll contact the guy I sold it to and see if he already activated it? Or would that even matter?

Just when you thought you made a quick 275 bucks, it ends up costing you 105 =O

I'm going to have to remember this in the future.

He can just as easily tell the buyer that he will tell verizon the phone was stolen and now its a paperweight. He has the buyers 275 lol.

---

Call Verizon and tell them you gave the phone as a present to your mom and you are using the razor that you always had.

Really though, in all my years of working in cellphone companies and now just dealing with cellphones I have never heard of verizon doing this. You extended your contract, they subsidized your phone, what do they give a **** what you do with it.

So you think I would be better off just contacting Verizon and telling them I just didn't want it once I got it and gave it as a gift? If that would work that would be awesome.

My friend called me a "schemer". Telling me to just keep the new phone and stop selling everything I have on ebay. I tried to explain that $275 could better serve me than the fancy phone would.

I saw all the other ones listed on ebay and figured that I would just flip it like everyone else was. I never thought about having to activate it or anything like that.

Of course they are going to be pissed you sold or gave away the phone. Now they have one less customer they can sucker in with a 3 year contract to get the same phone. You have potentially cost them business. For them it is more valuable to have a new customer on a new 3 year contract than to have you sign again.

Assuming the seller hasn't already activated the telephone talk to them and tell them that the Telco has flagged the phone and it will no longer be able to be activated with out a three year term. Offer to refund them their money. Once you get the phone back activate it then sell it. Make like you are doing the right thing and helping the buyer out.

Verizon sucks.
I bought a gimped HTC Touch Pro off them at contract upgrade time. It was unusable because the Verizon version had 1/2 the memory yanked.

Under their 30 day satisfaction plan, I sent it back for an Omnia, which sucks a little less.

three months later, Verizon still hadn't credited my account for the returned HTC. They claimed they never received it. When I produced the FedEx signed delivery receipt, suddenly they found it.

They are truly crooks. Don't even get me started about how they disable the GPS feature that's built into the phone I paid for, then demand $10 a month to re-enable the GPS that I already paid for. Rat Bastards.

They cant tell you what to do with your phone.

Unless it strictly states in the TOS that you must activate the phone you got from them, then you are free and clear to do whatever you want.

http://www.verizonwireless.com/b2c/g...rAgreement.jsp

Just read through that. Nothing in there says you must use their phone. Anything related to the phone is pretty general as it is, but nothing states you cant resell it and use an old one.

Oh yea, Verizon Wireless and Verizon are ******* criminals.

------------

You can also tell the guy you sold the phone to, too hurry his *** up and put the phone on his account.

Sam, I've had my doubts with you before but really man, thanks. I was wondering if it said anywhere in my renewal contract that I HAD to use that phone. Thanks for taking the time to help me out. I'm gonna call Verizon sometime tomorrow and go with I gave it as a gift and still use my old phone. Hopefully it all works out, but I feel more comfortable now. Thanks again man.

I believe the phone needs to be activated to your account first before the other guy can activate it. Luckily it should be an easy fix. You need to email teh other guy and get him to give you the esn off the voyager and another phone that you can call him on. You also have to have a landline handy. Log into your verizon account online. Then there should be a place on the left hand sign that says activate a diffrent phone. Do that, then enter the voyagers esn. Then call the other guy and have him turn on the voyager and dial *228 to activate the voyager. Then go back to your verizon page and enter the esn number off your razr. This will deactivate the voyager and you should be able to get rid of the chargeback easily

I hope im right, if I were in your shoes this is how I would react and handle the situation. Mention the phone as a gift, mention the TOS, mention the fact that you are a customer for x amount of years and at no time you were ever warned that you could not do whatever you want with the phone. All you thought was, hey contract extension.... cheap phone... sick.

However, if you are gonna mention the phone was a gift, say it was your uncle because if they get smart and check what account the ESN is on and its not a women(cause I said earlier gift for your mom) might be strange.

Hell id call them for you just for sport. Wouldnt be the first time I tangoed with a company.

^ He didn't receive a charge back yet, they are threatening him with one.

Basically, what Verizon is thinking is that he is a "new customer", he got the phone, didnt activate it and is now gonna bounce. In my mind there seems to be no other logical reason.

Verizon doesn't appear to be the brightest bulbs in the box.
