A Detroit resident is suing the city and a police officer for killing his dog - and it was captured on police dash cam.

The owner of the dog, Darryl Lindsay, says it's a violation of his civil rights as details are laid out in a 19-page lawsuit against the city of Detroit and a police officer. The incident was captured on police dash cam.

Officers were searching for a suspected shooter and ended up shooting the family pet. The dog's name was Babycakes, the family pet seen here with her owner Darryl Lindsay.

A police officer shot and killed the dog while trying to track down a suspected shooter.

"What we want is a figure to ensure this never happens again in the city of Detroit," said attorney Chris Olson.

It happened on January 31 on the northwest side of Detroit as police dispatch receives a disturbing call from an officer.

"Shots are coming from a yard."

Officer Darrell Dawson was one of first on the scene relaying info back to dispatch.

"We got a dog in the driveway of this location," he said.

On the police dash cam, you can see the dog on a 10-foot chain walking past the downspout of the home. You can also see Dawson, standing feet away from the dog.

"The dog is chained up in the driveway," Dawson says on the video. "I'm in the rear of the location. I'm going to take this dog down."

Two shots are fired. The first hits the French Mastiff in the chest. The second comes 30 seconds later in the side of animal.

Police were under the impression that someone was firing at them, so they tried to get access to the backyard.

"Whatever he was looking for in the back of the house," Olson said. "He could of just went the other way and skipping the shooting the dog part."

It is an opinion shared by another member of Detroit police and can be heard on police microphones at the scene.

"the dog didn't have s**t to do with it," she says.

FOX 2's Dave Spencer arrived minutes later to the scene after the dog is taken by her owner to the vet.

No police at the location would talk about what happened.

Spencer did speak to a woman at the house that day who couldn't understand why their dog, tied up to a fence, would be shot and killed.

"You have to take reasonable steps," Olson said. "Which include doing things other than just blasting the dog off the map."

According to a police report, it found no violation by the officer saying police could use deadly force if they feel threatened.

The city was just served with the lawsuit and hasn't had a chance to review the allegations. It now has a month to respond to the lawsuit.

The attorney says no one has reached out to the family to apologize or offer any explanation of why the family pet was shot and killed.

New York traffic wardens issued two parking tickets to a car whose driver was later found dead in the front seat, it has been reported.

Police have launched an investigation into whether the wardens saw the body of 47-year-old Mamadou Barry but failed to report it.

Two parking tickets were found on the car, which was sitting in a zone where vehicles are not allowed to park between 11.30am and 1pm.

And while the first ticket was discovered inside the car and dated 23 June, another was still fixed to the windscreen when police were called, witnesses said.
On the day the body was found, wardens had apparently ticketed both the cars in front and behind Mr Barry’s Buick Regal – but not his.

Officials said they were investigating why wardens had failed to give Mr Barry a third ticket.

As to why Mr Barry was found dead in the car, police reportedly said he appeared to have died of natural causes.

Extra jobs are allowed by the Houston Police Department-- with one major and no-brainer of a rule-- you can't work them at the same time you're on the city's dime.

But that's what we found Senior Officer Richard Still doing on his HPD shift at the private St. John's School in River Oaks, where records show he's held extra job for at least the past year.

"I don't, I don't know how to explain that, but I don't go to the school when I'm working," Still said.

"I'm just telling you, I've done nothing but my job for 33 years," he added.

But I-Team cameras caught him at the school several times when his weekly time card stated he was on patrol.

Officer Still: "I was on school property?

I-Team: "Yes sir."

Officer Still: "No sir."

I-Team: "For long periods of time."

Officer Still: "I don't believe that sir."

I-Team: "Well, the video says otherwise sir."

Officer Still: "I don't believe that sir. I don't know what to tell you."

But if the video is not to be believed, then what about the GPS records from the officer's patrol car. Over a two and a half month period, the global positioning coordinates tracked the officer at St. John's 15 separate times during his shift, for 20 minutes or more.

We showed our findings to Larry Karson, criminal justice professor at the University of Houston Downtown.

I-Team: "Is the public getting cheated here?"

Professor Karson: "The public may be getting cheated, the department may be getting cheated. The city has been compromised for what they expect, they aren't getting the full value of their officer who seems to be working extra job on duty."

The I-Team discovered other red flags, such as daily activity reports Senior Officer Still must fill out.

On February 5, 2015, he said he was on a major accident on Richmond Avenue from 9:25 a.m. to 10:15 a.m. But for the last half of that call--GPS shows he was at St. John's School. In another case, on March 19, 2015, he said he was on a rape investigation call on Westheimer for two hours. GPS records show he was at St. John's for the last hour and 14 minutes of it.

"We have this perception that both policy and possibly laws have been violated," Professor Karson said.

The Houston Police Department confirms it has launched an internal affairs investigation into the alleged double-dipping, and a St. John's School spokesperson said it is cooperating with that probe. But despite all of the hard evidence, Senior Officer Still maintains he has done nothing wrong.

Officer Still: "The records are wrong sir."

I-Team: "The GPS is wrong?"

Officer Still: "Yes, well, I don't know if the GPS is wrong."

The 33-year HPD veteran ultimately said the school was in his patrol district, so it was only natural he spent time at the school.

"I have done nothing by job ethically and professionally, my entire career," Still said.

There are other questions about how HPD let Officer Still take the job to begin with. On his extra job application for St. John's School, he was supposed to put down what hours he'd be working. But instead, he left that part blank, and HPD signed off on it anyway.

An LSU Police officer accused of misappropriating police association funds over an eight-year period was arrested and charged with felony theft Monday morning, according to Sgt. Nick Manale, a spokesperson for Louisiana State Police Troop A.

Carrie Richardson-Heckard, 46, of Denham Springs, is suspected to have committed the theft through her position as treasurer of the LSU Police Association from 2006 to 2014, Manale said.

The investigation began in January after the association performed an audit of its bank accounts and found the misappropriation of more than $16,000 in funds between November of 2007 and June of 2010.

However, after examining financial records, there wasn't enough evidence to definitively link Richardson-Heckard to the missing funds. But, association representatives found an additional unauthorized transaction in the form of a $1500.00 check issued to "Cash" written and endorsed by Richardson-Heckard.

Manale said the State Police and LSU Police Association investigation concluded that the check was neither approved by the association board nor recorded as a valid expenditure in meeting minutes or financial records maintained by Richardson-Heckard.

LSP Investigators believe Richardson-Heckard was criminally responsible for the misappropriation of the association funds and obtained a warrant for her arrest in East Baton Rouge Parish.

Security guards were caught on camera beating a teenager outside a shopping mall.

The incident occurred at The Mall at Stonecrest, which is about 20 miles east of downtown Atlanta.

The guards can be seen in the video beating the teen multiple times.

Witnesses say the security guards tried to get a group of teenagers to leave the mall and when they didn't, the guards began yelling profanities at the teenagers.

Jermere Stevenson says dozens of people stood by and watched.

"It was like 30-40 people outside just watching. I don't know why nobody helped," said Stevenson.

The Dekalb County Police Department is investigating. The teenager's name isn't being released because he's a minor.

A spokesman with the mall said the guards have been suspended without pay and will no longer work at the shopping mall.

Rank-and-file cops are fuming over several “police reform” measures City Council members plan to review this week, including bills that would force cops to get suspects’ consent for searches, imprison police for using chokeholds, and require cops to give out the Civilian Complaint Review Board’s phone number.

“These pieces of legislation have been proposed by individuals who have neither the expertise nor the experience to establish policy in the dangerous business of fighting crime,” PBA President Patrick Lynch said in a statement Sunday.

“Policing policies must be left to the police management who understand the intricacies and difficulties of complex legal issues and the appropriate use of crime-fighting tactics.”

The nine council bills up for review at Monday’s Council Public Safety Committee meeting include:

Requiring that uniformed cops provide their full name, rank and precinct, as well as the CCRB number, during any traffic stop or property search.

A measure that would allow police to use “injurious physical force” only “as is proportionally necessary,” but that does not define how proportionality will be determined.

Making the NYPD report the precincts of the 200 cops with the most CCRB complaints filed against them.

Councilman Rory Lancman (D-Queens), who sponsored three of the nine bills, said he welcomes Lynch’s input, but declined to say whether he sought it when drafting the proposals.

The public hearing comes a week after Mayor Bill de Blasio and City Council Speaker Melissa Mark-Viverito agreed to hire almost 1,300 new uniformed police officers by June 2016.

Body cam video obtained by 7NEWS of two Federal Heights Police officers shows one officer shove a handcuffed detainee into a wall then later punch him repeatedly in a jail cell.

The incident happened in December.

The 9-minute 30-second video shows Officer Mark Magness pull the handcuffed man from the police car then shove him face first into a doorway.

"Stand up!" Officer Magness yells at the man who's heard apologizing.

The man's face is dripping with blood as they remove his cuffs. Officer Magness orders the man to "get over here" to which he replies "F-you," before they shove him into his cell.

Things escalate when the man swings at Officer Magness's face with an open hand.

That's when Magness jumps on the man, punching him several times. The attack lasts nearly 10 seconds as the officers yell at the man to "stop resisting, stop resisting!" before pinning him to the ground and handcuffing him. Magness then grabs a prisoner restraint chair, flings it across the room at which point the other officer is seen pointing to his chest, warning him the event is being recorded.

"F that! F that!" Magness responds.

'I'm sorry, sir, I won't do nothing else" the man says as they throw him into the chair, blood now dripping from his chin.

The man remains handcuffed as Officer Magness grabs him and jerks him into an upright position.

"Sit back! Sit back!" Officer Magness yells pushing his head backward into the chair.

The man is again told to stop resisting, although video shows him sitting still while Officer Magness holds his head against the chair by his temples.

"We're gonna need medical," the second officer says pointing to his chin.

"I don't care, strap him to the chair," Magness replies at which point the second officer again points to his body cam.

At one point the man yells "ow!" as Magness pokes him in the temple, to which Magness replies, "no this is ow," as he jams his finger underneath the man's ear.

Court records show Magness pleaded guilty to attempted third-degree assault for the attack on June 17 but it's not his first disciplinary action.

In 2009, Magness, then just a one year veteran of Federal Heights Police, pleaded guilty to a misdemeanor charge in Adams County and paid a $517 fine after Dennis Discua and several witnesses said he threw him to the ground, breaking his arm.

"When I saw [this video] I remembered when he just grabbed me and I didn’t resist or nothing and he just pushed me and throw me all the way down," Discua said.

Discua said Magness refused to get him medical help and left the scene. When Discua called 911, the dipatcher sent the nearest officer, Magness, who returned and pretended to not know what happened.

"The police are supposed to help people, not hurt people," Discua said.

7NEWS called Federal Heights Police to ask about the status of Officer Magness, but have not yet heard back.

Former Secret Service agent will plead guilty to charges connected with the theft of electronic currency during a high-profile investigation into online drug bazaar Silk Road, federal prosecutors said.

Shaun Bridges of Laurel, Maryland, was charged in March with stealing $820,000 worth of bitcoin after authorities said he obtained passwords to the multimillion-dollar marketplace for illegal drugs and other contraband.

"Mr. Bridges accepts complete responsibility," his lawyer Steve Levin said Thursday. "He's regretted his action from the start."

Fmr. Federal agents from Md. charged with Bitcoin money laundering, wire fraud. Bridges resigned abruptly from the Secret Service earlier this month; Force also resigned from the DEA.

Levin declined to discuss the details of the plea agreement, which has not yet been filed with the court. Levin also declined to discuss what type of sentence Bridges is expecting.

Bridges is expected to formally plead guilty later this year to money laundering and obstruction charges, federal prosecutors said in a court document filed Wednesday.

Bridges was a computer forensic expert who helped arrest a Silk Road worker who controlled the website's passwords.

Separately, former Drug Enforcement Administration agent Carl M. Force is charged with extorting Silk Road operator Ross Ulbricht, who has been sentenced to life in prison after being convicted of seven drug and conspiracy charges in February.

Force's attorney Ivan Bates did not return a call for comment.

Force worked undercover and was tasked with establishing communications with Ulbricht.

Ulbricht was accused of creating the multimillion-dollar marketplace for illegal drugs and other contraband and adopting the alias Dread Pirate Roberts, a character from the movie "Princess Bride."

The website promised its buyers and sellers anonymity by using encryption and bitcoins.

Force is charged with wire fraud, theft of government property, money laundering and conflict of interest.

Force remains jailed pending his arraignment. A magistrate judge denied bail after ruling the former federal agent was a flight risk.

Authorities say an infant was pepper sprayed after being caught in the middle of a chaotic love triangle.
On Monday, investigators released new information on the arrest of a man who was both a Clarksville firefighter and a police officer, including how police say the two-month-old ended up being pepper sprayed.

Charles Edelen emerged from Court with no words. Newly released records say his two-month-old step-daughter's face was burned so badly by pepper spray, her eyes swelled shut.

She was rushed to Kosair Children's Hospital with potential respiratory problems.

"It wasn't his intent to hurt the child," said Larry Wilder, Edelen's attorney. "What you got to understand is this: when you use pepper spray, it fills a room...and the effects are going to be felt upon by lots of people who are there."

Edelen's estranged wife, Samantha, had a child with another man while they were separated. Attorneys say the couple reconciled, but last week, the girl's father, Darius Henderson, came to the Edelen's Jeffersonville home to talk about custody -- and tempers flared.

"The boyfriend showed up and there was dispute that Mr. Edelen had with his wife over the fact that she wouldn't' put pants on," Wilder said. "She was in a tank top -- no bra and panties -- and he took offense."

Edelen is accused of pepper spraying his wife and her ex-boyfriend while he was holding the baby -- but Wilder says it may have happened differently.

"Don't know that he was holding a baby when that happened," Wilder said. "We'll find out in discovery...exactly what was going on."

Wilder says Edelen only used pepper spray to protect his home.

"It's preferred over guns, obviously, and that was his choice to try and remove someone from his home, when they refused," Wilder said.

A neighbor called 911 when the fight spilled out of the Edelens' home. They say the Clarksville firefighter and reserve police officer was threatening to harm himself with a gun.

Edelen has been suspended from the fire department without pay and has resigned from his reserve position with police.

As for his marriage, measures are being taken to end it.

A former Firebaugh police officer was found guilty on Friday of one misdemeanor count of domestic violence. Jose Ramos Guerrero resigned from the police department after he was arrested in February.

The officer's wife claims she was hit in the nose and knocked out when she tried to break up a fight. But she says it wasn't her husband that hit her. Friends, however, claim the woman lied because she was fighting with her husband.

Guerrero is scheduled to be sentenced in August.

...The Washington State Supreme Court just ruled on Thursday that using such language against the police is completely protected by the First Amendment.

The Supreme Court opinion ruled that the charges in a 2011 “obstruction of justice” case must be thrown out. The court ruled that this charge was purely invented, trumped up by the officers and illegal.

In that case, the police were called to a Seattle home due to an alleged disturbance.

A 17-year-old juvenile, who has been identified as “Jordan” by her lawyer, to protect her identity, was upset at the officers who she believed had no business being there. But Jordan’s mother, allegedly had asked police to “remove her intoxicated and belligerent daughter.”

Being “belligerent” isn’t exactly a crime though. And “removing” a child from the home of their parent because they parent calls 911, is a bit more complicated than Jordan’s mother apparently believed.

Being upset with the entire situation, Jordan dropped the “F-bomb” on the police. For her troubles and frustration, the police charged her with obstruction of justice… all over a word.

Associate Chief Justice Charles Johnson said, in the court’s majority opinion, that even though Jordan’s “words may have been disrespectful, discourteous and annoying, they are nonetheless constitutionally protected.”
