An argument over texting in a Florida movie theater Monday triggered a retired Tampa police captain to fatally shoot a man sitting in front of him, as about 25 horrified moviegoers looked on, sheriff's officials said.

"Somebody throws popcorn. I'm not sure who threw the popcorn," said Charles Cummings, who, as a birthday treat, was about to watch the movie "Lone Survivor" at The Grove 16 Theater.

"And then bang, he was shot."

From what I've read the officer above stopped the EMTs from treating Kelly so they could treat his little wound on his elbow first.

An Orange County jury Monday found two former Fullerton police officers accused of killing a schizophrenic homeless man, Kelly Thomas, not guilty.

Manuel Ramos and Jay Cicinelli were charged with striking Kelly Thomas with a baton and a stun gun in a beating that left him comatose. He died five days later.

SHERIDAN, Ore. -- McMinnville police arrested a reserve Yamhill police officer who investigators said assaulted and critically injured his girlfriend's 4-year-old son.

Michael Shane Abo, 34, was arrested Saturday morning. He faces charges of assault (first degree) and criminal mistreatment (first degree).

Police said Yamhill County sheriff's deputies responded to a medical call about an injured 4-year-old boy at Abo's home on Dec. 31.

The boy was flown by LifeFlight helicopter to OHSU in Portland where he is in critical condition, police said. Investigators believe his injuries resulted from physical abuse by Abo.

Neighbors say they always thought something was off with Abo.

"If the little boy was in momma's car going to McMinnville, he would always blow a kiss at me when they left. But if he was in daddy's car, he was not allowed to look," said Ruby Swartz, Abo's neighbor.

Yamhill County Sheriff Jack Crabtree requested that McMinnville police investigate the incident because Abo is a reserve police officer and a former Yamhill County sheriff's deputy.

Police took Abo to the Yamhill County Jail. Bail was set at $1 million.

The Los Angeles County Sheriff's Department carried out a felony search warrant Tuesday at Justin Bieber's California mansion in a vandalism probe.

The search warrant stems from allegations of an egg attack on a neighbor of Bieber's last week, a sheriff's department spokesman said.

That leaves me fucking disgusted. I don't usually wish harm upon people, but I wouldn't lose a second of sleep if someone gave Ramos the same treatment.

I hope I don't match any descriptions... Apparently these days that's reason enough to be pushed against the hood of a car, choked and have someones hand pushing your face/head back while they try to cuff you.

Cops should be able to take an ass whooping like anyone else when they are out of line. Looks to me like the cops came in talking shit, trying to be all tough, and were met with more knowledgeable people than they expected. Of course the fucking department found justification in use of force. How often do they not, generally speaking. 1 in 1000 cases? All I saw was the victim trying to get the cops hands off of him, which were there without cause in the first place. I would have done the same in his situation. They have no right to put their hands on someone, especially not without probable cause, which they didn't have.

MELBOURNE, Fla -- The family of an elderly Melbourne with dementia man says they plan on suing the police department -- all over a violent confrontation that was caught on camera.

The dash camera video shows 66-year-old Albert Flowers being kicked by Melbourne officer Derek Middendorf back in October. Flowers was also punched repeatedly, and another officer used a stun gun to shoot him in the face.

Police reports said the officer was investigating a call about an argument at the time. Officer Middendorf said Flowers was acting aggressively and refused to stop at a safe distance.

But the man's family said they're horrified and that the officer went too far.

"I know he has a job to do, but when you take it above and beyond after being warned that he has dementia when you are warning that he has dementia and be brutal like that it's criminal," said Flowers' son Carlos.

News 13 contacted Melbourne Police. They referred us to a spokesperson for the city who said because no complaint has been filed yet, they have nothing to respond to.

They do say though the officer turned off his camera before the incident - but the video was still able to be retrieved from a hard drive.

A hearing is set for Wednesday.

Meanwhile, the city says Officer Middendorf is still employed with the police department, but is currently off the job after an unrelated injury - 15 January 2012
Officer was only punished for turning off his dashcam.

A California high school student was suspended after a deputy accused him of instigating a fight with another boy despite the fact that a cell phone video clearly shows he was walking away from the boy who kept pushing and shoving and hoping to instigate a fight.

However, the assistant principal never bothered watching the video nor decide to talk to any witnesses to justify Kobe Nelson’s suspension.

Instead, she based her decision on allegations from San Bernardino sheriff’s deputy Louis Ortiz, who mocked and ridiculed Nelson for being too skinny then accused him of instigating. Ortiz also warned Nelson that he if returned to school within two days, he would be arrested.

However, the boy’s father, Tommy Purvis, a journalist friend who lives in California, is livid about the treatment of his son and is doing everything in his power to remove the suspension as well as complain about Ortiz.

He is meeting with the sheriff’s department Tuesday morning to complain about Ortiz lying about the events that led up to the altercation.

Purvis provided the following synopsis:
I was called Wednesday afternoon by Assistant Principal Gayle Ross from Etiwanda High School. I was told Kobe was being suspended for two days for being involved in a fight. I asked to talk with Kobe. He told me that a San Bernardino County Sheriff deputy was looking at him. It was clear that he was not hurt. I told him to be compliant, and we’d figure the rest out later.

I would have picked Kobe up from school, but I was four hours away by car. My wife went to pick him up from school instead. She also gave his friend from the football team a ride home. I briefly talked to Kobe. He told me a real quick version of the story. His friend told me the same thing. Kobe had been pushed around, but he did not fight back.

I first saw the video Thursday afternoon. I’d just arrived home, and I wanted to first hear Kobe’s full side of the event in person before contacting Ross again. He told me that he was pushed around by a guy on the wrestling team. The guy was jealous over an ex-girlfriend that had been paying attention to Kobe. It was the same person that he had previously been bullied by at Summit Middle School.

Kobe told me that there were at least seven film versions of the encounter going around the school.

I called the school to speak with Ross, but I talked with her secretary. She confirmed that she was in the office when Kobe was brought in for questioning. Kobe was trying to walk off his anger after the situation when he was met by a campus security officer. The officer took him to Ross. She was questioning Kobe when San Bernardino County Sheriff Deputy Louis Ortiz came into her office.

Kobe made an effort to tell Ross that he was confronted, pushed, and thrown to the ground by his backpack. It was then that Ortiz began to mock Kobe. He told Kobe that the fight was his fault for being a victim. He told Kobe that if he bulked up than he’d be safer. Ross did not correct Ortiz.

I was told on Thursday afternoon by Ross’ secretary that an end of suspension meeting would be held Friday at 2 PM. I went to Etiwanda early Friday morning before work. I was not aware if Ross had seen the video. She would not watch it with me. She told me to turn it off, she’d already seen it. Kobe had been suspended for instigating the fight, not for physical force.

Ross told me that the Chaffey Joint Union High School Education Code gave her the right to suspend Kobe for instigating the fight. It would not be expunged from his records. I was told that Kobe had threatened to beat up the bully through the ex-girlfriend. I was given no proof of the allegations. Kobe told me that he never threatened the bully. The aggressor was simply jealous that his ex-girlfriend had tweeted about meeting Kobe over winter break.

I then sent Ross a follow up email, along with a text message from the ex-girlfriend to Kobe. I went to the San Bernardino County Sheriff to file a citizen complaint after work on Friday afternoon. I will send the complaint after I file it in the morning.
The assistant principal has since requested to see the video, even though she claimed she had already seen it.
