doesn't a MS count as a "timing control device" if i remember correctly as long as its not a full stand alone it should work. Im in norcal, however i use a mspnp so i cant help you out there.

you shouldnt "need" the bipes to pass the ref, just set the timing to 9.5* (where ive found does best for emissions) and dont go into boost. It would not effect the emissions at all that way ... just dont see what the problem would be. However if you do need to get one, offer to put up a paypal deposit that they can send back to you when you send the bipes back. I wouldnt send something like that off to someone i dont know without collateral.

I found a blue Miata MSD in my friend's garage. It says boost controller on it. It looks like the one on flying miata's website but looks a little older. is their anyone out there using somthing like that out there to controll timing?

The MSD is the original timing device, one of the first used on Miatas so you shouldn't have a problem. Are you going to get a smog test or going to the state BAR referee? There's a big difference.

If you're going to the state ref your car needs to be the exact spec of the CARB certification so you need to look at that for what you need.
