I applaud that officer, but I believe here in Cali you are technically allowed to remain in the 'fast' lane even if you are holding up the flow of traffic UNLESS IT IS POSTED that slower traffic must remain to the right. Infuriating as hell!

They'd get more speeders too if they enforced left lane for passing only. I've had more than a few lucky instances where I've been in a rush, driving too fast, and the one cop I pass is while I'm stuck behind someone doing 55 in the fast lane.

Untrue. In CA, you are legally required to move to the right if you are traveling slower than the flow of traffic, regardless of whether you are going the speed limit or not. CVC 21654(a) here: CA Codes (veh:21650-21664)

every 2 miles, the right lane ends, forcing people in the right lane to merge. Then a new left lane is added. This essentially forces all drivers to the right of the road over time and allows left lane passing with ease.

It appears you're right sav. I guess since it's virtually unheard of them to enforce this here, I thought it was only where they bothered to post it that it was enforceable.

However, I did come across a posting by a retired CHP officer that mentioned the following:

On multi-lane roadways where the average speed limit may be higher than the posted limit, but not exceeding the maximum permitted speed limit, a driver who is driving in the left lane and causing traffic to pass on the right, that driver may get a ticket for impeding traffic. It does not happen often, but it can happen almost anywhere.

Given that nearly all freeway traffic in Cali already exceeds the maximum permitted speed limit, the point becomes moot doesn't it? If that officer's comment is true, then if you're going 70 in the fast lane, yet the traffic is flowing at 80 around you, they can't ticket you because you're already at or above the maximum?

It seems like this law would apply more where the posted limit is 45 or 50, yet traffic is flowing at 60-65, and there's an ******* in the fast lane doing 55; all speeds at or below the maximum speed limit.

People can BARELY handle merging with the system that's in place now. Adding additional merges every 2 miles would destroy mankind!

Seriously though, people driving slow in the fast lane need to be ticketed. Start enforcing it enough and it'll help, just like with speeding. Right?

Yeah, I do see what you mean and you're right, but unfortunately, in practical application it must become somewhat of a grey area, as leo's will almost unanimously give precedent to enforcement of maximum speed limits violations. It would seem that when there are two, or multiple, potential violations occurring simultaneously (by different parties), they will give precedent to the most egregious. I have lived in norcal my entire life and, just as 18psi said, I have never heard of a single person receiving such a ticket on a multi-lane highway or freeway here.

last time I high-beamed someone for driving slow in the left lane, he brake checked me down to about 25 mph. I could not get a non-blurrly license plate photo. so pissed. and unfortunately the car was a black hired car so it's not like the po-po can look that up easily.

i should just move to europe where people aggressively move to the right to stay out of the faster lanes.

I was just going to bring up Europe, but you beat me to it. We drove all over Germany, Belgium and The Netherlands (although the memories of that leg of the journey are hazy..) and noticed that keeping to the right when not passing was taken very seriously there. A friend who lives there explained that Drivers Licenses are much more difficult to obtain, involve a fair bit of training, and the authorities aggressively ticket those in the left lane. Tooling around in a Smart (a *euro* Smart, the 700cc REALLY tiny ones) and being passed by Mercedes sedans at easily three times our speed one learns very quickly to stay out of the way.

really? that's like my drive to work each morning. I probably flash my lights once a week.

however, the only issue I've had driving to work in the last year only resulted after having to driving through Arlington because of an early morning detour...seriously three road rage incidents in one day.

one of them being a pedestrian that didn't like the volume of my 110dB horns blasting for about 30sec. straight because the person in front of my stopped in the middle of the road to drop off someone at the metro without regard to the people behind him or an attempt to not block a roadway and got right up on my window and tried to somehow intimidate me through glass...
