I'd add to that list:
- One is easier to get at a lower price
- One is obtained faster at a lower price
What JDM shops need to do if they want a competitive presence in other markets is to find distributors that can stock their product, and sell it at a price that the market will bare. Priced high, sell little. Priced low, sell lots. Simply put, economics pwns JDM tuners because they have not built there business around selling parts to a world market.

My last comment. I read the whole thread, don't worry. You just said it here, Ford made a STRIPPED DOWN COPY. He didn't make an exact replica of other's work and I give him props for this.
Look, I couldn't care less if the guy did a copy of it to just sell it for his friends and that would end there. But when I saw a guy claiming he was selling Tuckin99 flares on CR.net for $450 I thought it was the used price, no problem with that. When I found out it was a reproduction, I felt totally pissed off and now tell me who's the bad guy. I don't use other's item recognition to sell them and that's a very bad way to do business.
I don't want to be an ******* or anything, but if I was acting using the free market method, I would just open a factory in Mexico, wait for someone to develop part, copy it and sell it for cheaper 2 weeks later. Would you still buy the original's hard work or mine ?
You might say whatever you guys want about me, I'm a honest guy and do this for a passion.

neogenesis2004, please don't get started with the touge thing. Hey, everyone can take a current product and just change the material. Heck, I could even buy racing beat bumper and have it made the same material. The guy could at least have altered the design, that's what I'm saying. How about if I buy 6UL wheels, have them made cheaper, stronger and lighter somewhere else in the world, if I run over it using a hummer and test both side to side to prove my improved (other material) version is better ? Will you feel good buying a product from a guy that just copied Emilio's hard work, the work of a guy that helped the Miata industry a lot by bringing very nice products to the market ?
To everyone else, thanks for not starting bitching about me and kept it civilized, I wanted to explain my case and how I see what's happening.

1) your not a product designer or developer like 949racing, infact quit using him as an example because it makes you look stupid
2) 949's products really can't be produced much cheaper, thats because he is actually offering reasonable prices, so he doesn't have much to worry about
3) your just a middle man importer, you offer nothing to the miata community but high priced jdm parts
4) show me the paper work on the flares, either way it doesn't matter because Rharris is perfectly in his right to copy them here in the USA
5) instead of being a JDM douche bag why don't you have Rharris make you some exclusive parts
6) the parts are cheaper, made locally, and probably stronger

Where I'm going at is GUYS, the industry is falling under counterfeit products and the new and hot parts are rare to come across. Instead of encouraging a guy that just bought a piece and made a mold of it, why don't you guys buy parts from people like Mike @ Autokonexion ? This guy is from USA, he works his *** off to develop JDM inspired parts and very original products. You don't have to wait neither. The quality is there AND you're helping the industry.
Oh well, I'm not a dictator, but guys, do whatever you want but instead of coping ****, just inspire yourself or improve the product. By improving the product I'm not talking about changing the material.

autokonexion's makes a replica of the N2's but yet CR.net still supports their buisness and sales! there not the real ****** deal, but they are still selling them. so why doesnt CR flame them for doing the same thing thats being done here (making a replica of a piece of **** overpriced part that can be made better and sold cheaper to help out poor ******* like myself who cant afford expensive junk like most of you JDM TYTE ***** over on CR can)!!

Ford wants to make sure that you source your replacement bumper from them, and not a different company making replicas of their bumper. This is already having a large effect to auto body companies. They (auto mfgs) are starting to enforce their patents to protect their designs.
So the lesson is:
If you don't want your **** to be copied--get a design patent. If your product is successful, it WILL be copied.
Invert, here is the bad news - you cannot get a patent for a product that has been for sale within the U.S.A. for more than 1 year. You are S.O.L.
If you want, as a patent agent, I can give you some more advice. My rate is $100.00/hr. and I require a 5 hour minimum. (this way i can buy a knock-off of a knock-off of a knock-off fender flares. )

The whole situation in general with this has become so touchy over there, that it just isn't worth bothering with. The way I see, I am not really taking any material market share from Tuckin'99 on these flares. The people that are hardcore and have always wanted the Tuckin flares, will end up buying them because they see part of the value lying in the JDM factor. The people that will end up buying mine, couldn't really see spending that kind of money for a part that derives partial value from being made in Japan.
I appreciate everyone's support and understanding the situation from a objective standpoint. I want to try to get as much stuff out to you guys at a reasonable price and will continue to try to do that.
