Which civil court typically is. I can't imagine them not ruling to Zombie's favor...hell even if he just asked, in court, to recieve a copy of all the shots in high-res and a license to use them as he pleases for non-commercial purposes. really, the argument isn't over the money, it's about him getting a copy of the pictures.

 

Again, I completely agree. I get the feeling that you're trying to counter an argument which I am not making.

All this talk of copyright was meant to address only one simple thing- Y8s' advice that he "would check into the copyright law for this specific case." Nothing more than that.

I'm making no prognostications about the likelihood of receiving any particular judgement from the court, merely advising that copyright law is NOT on Zombie's side in this situation, and that bringing it up in court would tend to harm his case (by providing reinforcement for the rights of the photog) in the unlikely event that a judge were to actually read the law prior to issuing a decision.

Hi guys this is the wife, thanks for the posts. I think now I would just like my money back, cause I have nothing to show for and if she were to give me any of the pictures all I'm gonna remember is the bitch that took our pictures and not the moments that were captured.

 

Not to threadjack, but a cool trick for occasions such as weddings is leaving a couple of disposable cameras on each table, and encouraging the guests to take pictures as they please.
They are also instructed to leave the said cameras at a drop box as they leave.

Some very cool shot turn out out of the hundreds, maybe thousand or so pics taken by all sorts of different people...

 

We did that. A lot of crap. Maybe half a dozen that were worth keeping. Certainly not worth the money it cost for the cameras and developing.

I have been to a couple of events where this was done. I got a chance to see the pictures later, they were actually quite good.

Depends on the crowd, I guess.

 

the reason I posted diplomatically about it was because I found conflicting information on the google. since google is not a member of the bar, I suggested finding an actual lawyer to clarify things.


Two things you can do to give your wedding back to yourself:

1. contact your attendees and let them know you don't have any wedding photos and can they send you the ones they took.

2. call a reputable photographer and explain to them what happened. get them to take you somewhere gorgeous and take some photos of you two. yeah I know it's not the same but you will have something to frame. Or find the closest miataturbo.net photography nut and have them do it. Just make sure you get them to sign something giving you partial ownership!

 

skimmed thread, too much to read, so pardon if this has been mentioned before...

Our wedding we had pretty much exactly the same situation: we asked a friend of a friend who was into photography to do it. He did it for FREE, as a wedding gift. Gave us 6 DVD disks with a total of 1600 (yes, not a typo) raw originals, and 300 COMPLETELY overhauled/touched up/processed "FINAL" pictures that look flawless even to this day.

I'm with y8's: just take some really good pics right now and forget the whole situation. Dragging it out any longer is just going to make you bitter and disgusted with it more, and just sh*t on your guys' feelings/emotions. The person you got screwed by is obviously a POS, forget the situation, take new pics and have good memories on your walls instead of something that will make you cringe or get mad every time you look at it.

 

Talked to a reputable photographer, showed her the pics we have, and she (and us) laughed for a while. Pretty much amateur hour. The more I look into it the more I want to throttle the woman. Things like why shoot in low res, never used a tripod, and fiddled with crap like it was all new to her.

Anyway. We are working it out with the lady. I'm ready to walk away and call it a mistake. Just not worth the stress. I'm letting the wife sort it. We plan on working out and losing some weight, looking better, and reshooting the things we wanted. Like I said my dad has a ton of photos from the event and we have a bunch from other attendees. Her father died shortly after the wedding so we need those. Thanks for the suggestions.
