oh like an ebay auction agreement is going to hold up in court, you know how many disputes i've had with paypal/ebay where someone specifically went against **** i said in my auction and they, themselves, the binders of the contract, didn't give a damn.
my problem is this: the issue/damage that was not disclosed, and this is a requirement in most states. However, I believe the laws related to disclosure in automotive sales differ in every state. But the problem is, you have to prove that they must have known about that preexisting condition and you can then confront the seller with the lack of disclosure and ask them to take the car back and refund your money in full, which will be hard to do, but give me a break.
But, that may only be for used car dealers, not private sales, where the car just needs a vin to be sold. I dunno, the guy has extra $$$, i'd exercise it, just cause I'd be pissed as hell.

I imagine their thinking may be that once they admit (even partial) liability, it opens up a whole world of hurt on them. Safer to deny. Not that I think that's the right thing to do, but they must be worried about potential lawsuits.
