I'm trying to figure out why MGM Resorts International (owner of the Mandalay Bay) is paying out $800 million to the victims of the 2017 shooting.

In what way was the hotel responsible for the actions of the shooter? This makes no sense. If anything, the hotel is a victim, as it has lost the value of the future use of Room 32135.

"We are writing to request that Facebook does not proceed with its plan to implement end-to-end encryption across its messaging services without ensuring that there is no reduction to user safety."


Those would be the words of US Attorney General William Barr, in an open letter (co-authored with similar officials in the UK and Aus), to Facebook CEO Mark Zuckerberg. They're afraid that governments will have a harder time spying on their own citizens if data passing through Facebook (including Facebook Messenger, WhatsApp, and Instagram) is fully encrypted from the app to the server.

How not violating the 4th Amendment decreases "user safety" is not clear to me.

In what dimension of reality is a hotel responsible for monitoring what its guests are bringing into their rooms?

Put another way: can you imagine the shitstorm which would ensue if a hotel installed cameras in guest rooms and monitored / logged what its guests were doing in said rooms?

This is such a weak case that I am ashamed of all of us.

Yes, let's have metal detectors and body scanners open up all of our bags to searches just like we're getting onto a f****** airplane every time we check into a hotel from now on please. That's exactly what we're asking them to do with this. We just told them that they are civilly liable if they do not do it.

That was the leverage used, nevertheless, and MGM was not happy with the odds of winning, which you correctly surmise reflects badly on the state of the union.

If I were lead counsel for MGM in this affair, I would have done the following:

1: Construct a small hotel (like, 4 rooms, tops) in Wetsack, Idaho. Same US District Court circuit as Nevada.

2: Install surveillance cameras in the guest rooms. Record and analyze all guest activity.

3: Get sued by a guest for said aforementioned surveillance.

4: Go to trial, lose, and pay a settlement.

5: BOOM! Precedent is set, ************.

6: Retire, and collect speaking fees as the most awesome defense attorney since The Glove.
