They wrapped him up with a blanket,&quot; Jones said.</p><p>Jones said had called for help earlier in the day when she and her boyfriend had an argument. Jones said the Sheriff's Office responded after she left.</p><p>A public information officer said that because of the nature of the call, deputies had to force their way in and the dog, named Itchygo, charged at them once they got in.</p><p>Itchygo was home alone.</p><p>&quot;That's his house. This is his house. He's got to protect this house,&quot; said Jones' daughter, Kita Williams.</p><p>Williams said since no one was home, neighbors who saw the shooting told them what happened.</p><p>Neighbors said they told deputies no one was home, but they went in anyway.</p><p>&quot;If three neighbors are telling the officers no one's here, that don't give you proper cause to continue coming in,&quot; said Williams.</p><p>Deputies said because they never received another call to cancel the response, they had to respond urgently.</p><p>Williams said she is concerned for her mother's safety living in the troubled Tymber Skan complex without Itcygo to protect her.&nbsp;</p><p id="202">

</p><p>A federal judge has issued a restraining order against Lee County Sheriff Tracey Carter in what may be an unprecedented case in North Carolina.<br /><br />It started when a 71-year-old investigator for a Raleigh attorney's office tried to serve the sheriff with a subpoena in a civil suit against the department.<br /><br />The investigator alleges he went to Carter's home, but no one came to the door. As he was leaving, he claims the sheriff came out, blocked his truck, and then Carter's deputies showed up to arrest him for trespassing.<br /><br />Raleigh attorney Kieran Shanahan convinced federal judge Terrence Boyle that the arrest was actually an attempt to obstruct the service of subpoenas. Boyle signed a restraining order against the sheriff and his deputies who are being forced to testify in the upcoming civil trial.<br /><br />&quot;In the environment we live in now where police are under scrutiny for acting out and misbehaving you would think that a sheriff in North Carolina would comply with the law and accept simple service of a piece of paper,&quot; said Shanahan.<br /><br />Shanahan told ABC11 he believes a federal restraining order against a North Carolina sheriff may be unprecedented.<br /><br />&quot;I don't think a federal judge would have done such a thing if he didn't also share my concern about a sheriff who's confused between enforcing the law and thinking they are above the law,&quot; he said.<br /><br />ABC11 reached out to Sheriff Carter for his side of the story, but we were referred to the Lee County Attorney. </p><p>A number of students at San Antonio&rsquo;s McCollum High School were charged with inciting a riot for their involvement in a food fight that took place at the school this Thursday just after noon.</p><p><em>&ldquo;It was a rowdy food fight. There were plates all over the floor, and corn in the air and some milk cartons as well,</em>&rdquo; student Adrian Toscano told KSAT-TV.</p><p>For some reason, the staff at the school was not able to control the situation, and they ended up calling the police, who came in and arrested ten students for inciting a riot.</p><p><em>&ldquo;Inciting a riot is because there was 900 kids in the cafeteria when the food fight started. </p><p>&nbsp;Investigators turned their attention Friday to the roof of the Twin Peaks restaurant in Waco where a shootout early Sunday afternoon between rival motorcycle gangs and police left nine bikers dead and 18 wounded.</p><p>The Waco Fire Department provided a ladder truck to allow investigators to inspect the roof in search of guns and other evidence.</p><p>Investigators from several suburban departments including Robinson, Lacy Lakeview and Hewitt were also at the restaurant Friday &ldquo;adding a fresh pair of eyes to the scene.&rdquo;</p><p id="278">

</p><p>A Polk County sheriff&rsquo;s lieutenant is accused of exposing himself at work and trying to convince a female employee not to incriminate him.</p><p>&nbsp;</p><p>Dexter Jerome Hill, 44, of Lakeland is charged with indecent exposure and tampering in a misdemeanor proceeding.</p><p>&nbsp;</p><p>Jerome, who has resigned, worked as a supervisor in the South County Jail.&nbsp;</p><p>&nbsp;</p><p>Hill is accused of exposing himself at work in front of a female employee at the jail, according to the Polk County Sheriff&rsquo;s Office. During an investigation, he contacted the woman and tried to influence her not to incriminate him.</p><p>&nbsp;</p><p>Hill was booked into Polk County Jail, but was released after posting a $1,500.</p><p id="189">

</p><p>The Teller County undersheriff and two deputies have been ordered to pay $72,583 in damages to a construction contractor after a federal jury found they violated his constitutional rights by <strong>unlawfully entering the sleeping man's van and unlawfully seizing him.</strong></p><p>Paul Bauman's lawsuit said SWAT team deputies used such excessive force against the man they dislodged his pacemaker, injured his heart and compressed discs in his spine.</p><p>After a four-day civil trial in Denver federal court, the jury on Friday found Undersheriff Stan Bishop, Deputy Josh Weatherill and Deputy Nick Hartbauer guilty on two counts of violating Bauman's Fourth Amendment rights against unlawful searches and seizures, Bauman's attorney, David Lane told 7NEWS.</p><p>The jury found Undersheriff Bishop was liable for the conduct of deputies Weatherill and Hartbauer and awarded Bauman $72,583 in damages for violations of his Fourth Amendments rights, Senior U.S. District Judge Richard P. Matsch wrote in the judgment. However, jurors did not find that the deputies used excessive force.</p><p>The lawsuit centered on the afternoon of Oct. 20, 2010, when Bauman was unwinding in his Toyota van after installing a new roof on a home in Cripple Creek Mountain Estates.</p><p>He had recently had a pacemaker installed for a heart condition and took some medication about 5:30 p.m. before falling asleep in his van,&nbsp; Bauman's lawsuit said. He was living out of his van and had permission to park on private property in Cripple Creek.</p><p>Little did Bauman know that he was about to be drawn into a police investigation about the theft of guns and ammunition.</p><p>A day earlier, a local man reported to the Cripple Creek Police Department that he'd returned home from vacation to find that someone had broken into his home and stolen about 60 long guns, 24 handguns, and 10,000 rounds of ammunition.</p><p>The following day, Cripple Creek police Sgt. &nbsp;April Peterson was contacted by an informant who said he had individuals who were offering to sell him a large amount of guns, the lawsuit said. The informant told the sergeant that he would &quot;organize a drop location and time&quot; for police to move in and arrest the people offering to sell the guns.</p><p>The informant told Sgt. Peterson to meet him at Johnny Nola&rsquo;s Casino in Cripple Creek. But when she went there, the informant never showed up.</p><p>Sgt. Peterson had two officers conduct surveillance outside the informant's motor home, which was located on private property near Colorado and Warren avenues in Cripple Creek.</p><p>While watching for the informant, the officers spotted Paul Bauman getting into his van on the property.</p><p>...</p><p>According to the lawsuit, law enforcement officers decided to enter Bauman's van and the mobile home of the informant.</p><p>Despite not having a search warrant and having no information that Bauman had committed a crime, one deputy broke a rear window of Bauman&rsquo;s van, while the other threw open the rear door to the van, the lawsuit said.</p><p>The deputies dragged Bauman out of the van, causing him to fall on his back and they &quot;pinned him to the ground by stepping on his groin with their feet, which caused his pacemaker to dislodge,&quot; the lawsuit said.</p><p>...</p><p id="241">

</p><p>In 2008, Neal Malangone was being trailed by cops for allegedly throwing a garbage can through his mother-in-law&rsquo;s window a few days earlier. Detective David Gross and two partners followed Malangone, eventually cornering him in the vestibule of a Chase bank on Woodhaven Blvd. in Queens.</p><p><a href="http://www.copscaughtontape.com/wp-content/uploads/2015/05/beating.png"><img alt="beating" src="http://www.copscaughtontape.com/wp-content/uploads/2015/05/beating.png" style="border-width:0px; float:left; height:auto; margin-bottom:10px; margin-right:15px; width:312px" /></a></p><p>A surveillance video from the bank shows Gross entering the ATM lobby with his gun drawn and what appears to be a baton in his other hand. Malangone immediately raised his hands, palms-up, then put his arms down, walked to the middle of the lobby and appeared to be lowering himself to the floor when Gross kicked him in the upper back.</p><p>When Malangone rose, there was a bloody trail on the floor and the side of his face was streaked with blood. Moschella conceded that Gross&rsquo; gun struck the suspect in the head &ldquo;unintentionally&rdquo; while he was trying to subdue him.</p><p>Det. Gross swore that Neal Malangone had assumed a &ldquo;boxer&rsquo;s stance,&rdquo; refused &ldquo;six or seven&rdquo; orders to get down, and flailed his arms, leaving him no choice but to use brutal force against the man.</p><p>The problem for Gross is that virtually none of that story appears to be true. The city has settled the lawsuit for $185,000.</p><p>Gross has been named in at least five other lawsuits, according to data obtained by The News. Two of those lawsuits &mdash; one involving a teenager who was shot when Gross and his partner mistook a water gun for a Tec-9, and the other alleging Gross shot a Brooklyn man from behind for &ldquo;no justifiable reason&rdquo; &mdash; each settled for $250,000.&nbsp;Gross, a 21-year veteran, retired from the force after he was cleared of the departmental charges in the Malangone incident.</p><p id="211">

</p><p>Maricopa County Sheriff Joe Arpaio is asking supporters to pay for the cost of his ongoing legal battles,&nbsp;<a href="http://www.latimes.com/nation/la-na-ff-arpaio-20150524-story.html" target="_blank">the&nbsp;<em>Los Angeles Times</em>&nbsp;reported.</a></p><p>&ldquo;In some instances I have to personally pay for attorneys to represent me in these cases,&rdquo; Arpaio said in an email to fans late last week. &ldquo;I do not have the personal wealth or the wherewithal to keep up with the costly demands of paying for attorneys to defend me.&rdquo;</p><p>Arpaio made his appeal a day before filing for the removal of District Judge G. Murray Snow from contempt of court proceedings against him.</p><p>The sheriff&rsquo;s attorneys argued that Snow is incapable of being impartial in the case because of a situation created by Arpaio&rsquo;s own representation; Arpaio&nbsp;revealed last month&nbsp;that a former attorney hired a private detective to investigate Snow&rsquo;s wife.</p><p>&ldquo;No reasonable person with knowledge of the facts can deny that Judge Snow is now investigating and presiding over issues involving his own family,&rdquo; Arpaio&rsquo;s current lawyer, Mel McDonald, argued.</p><p><a href="http://www.phoenixnewtimes.com/news/arpaios-desperation-move-lawyers-move-to-disqualify-judge-snow-7352908" target="_blank"><em>Phoenix New Times</em>&nbsp;reported</a>&nbsp;that McDonald and his team &ldquo;rode on the coattails&rdquo; of conservative activist Larry Klayman in filing for Snow to be removed.</p><p>McDonald admitted to reading a motion Klayman filed&nbsp;earlier this month&nbsp;that also called for the judge to be removed from the case because of the investigation against his wife. Klayman&rsquo;s motion was unsuccessful.</p><p>Arpaio could be found in civil contempt of court stemming from the 2013 court ruling that found his department was engaging in racial profiling against Latinos. If Snow strikes down McDonald&rsquo;s motion, the sheriff is due back in court in June.</p><p>A former sergeant in his &ldquo;human smuggling unit&rdquo;&nbsp;testified last month&nbsp;that Arpaio allowed the practice to continue for more than a year after the decision. </p><p><span style="color:rgb(0, 0, 0)">The Wake Forest Police Department says an officer has &quot;been dealt with&quot;, but can't comment further after a man was arrested while videotaping the arrest of a friend.</span><br /><br /><span style="color:rgb(0, 0, 0)">The incident happened at an Irish pub in February. Robert Johnson told ABC11 he was nearby when his friend got into a confrontation with the bar staff.</span><br /><br /><span style="color:rgb(0, 0, 0)">&quot;I guess the bouncers were arguing with him for being loud or whatever,&quot; said Johnson.</span><br /><br /><span style="color:rgb(0, 0, 0)">When police arrived, Johnson started recording.</span><br /><br /><span style="color:rgb(0, 0, 0)">&quot;Kept a safe distance - just videotaping,&quot; he recalled.</span><br /><br /><span style="color:rgb(0, 0, 0)">That's when things took a turn in his direction. Minutes into the recording, you hear an officer tell Johnson they're going to take his phone.</span><br /><br /><span style="color:rgb(0, 0, 0)">&quot;He said that he needed my phone for evidence cause I was videotaping the arrest, but I know that wasn't right, so I kept taping,&quot; said Johnson.</span></p><p><strong><span style="color:rgb(0, 0, 0)">That's when the officer took the phone by force.</span></strong><br /><br /><span style="color:rgb(0, 0, 0)">&quot;He grabbed my other hand that was not in a cast and twisted it back and was trying to slam me on my face which eventually happened,&quot; said Johnson.</span></p><p><br /><span style="color:rgb(0, 0, 0)">The next thing you hear in the recording is the officer trying to turn it off.</span><br /><br /><strong><span style="color:rgb(0, 0, 0)">&quot;How do you stop your phone?&quot; the officer asks.</span></strong><br /><br /><strong><span style="color:rgb(0, 0, 0)">Johnson was arrested for resisting and obstructing an arrest.
