SF expected to pay $3.5 million in double-murder wrongful conviction - City Insider

A man locked up for 18 years after being wrongfully convicted in a double-murder case is poised to get $3.5 million from San Francisco.

...

Conley, 40, was locked up in 1992. In 1994, he was convicted and sentenced to serve two life-without-parole terms for a 1989 double slaying on Third Street that prosecutors said was gang-motivated. A judge ruled in December 2010 that he had been wrongly convicted. He was released a month later.

San Francisco Superior Court Judge Marla Miller found that police investigators knew that the prosecution’s star witness, Clifford Polk, lied on the stand about whether he was being paid, but they did nothing to intervene. Miller concluded that the lead investigator in the case, Earl Sanders — who later became police chief — knew about the perjury “and did not correct it.”

Miami Cop Fearing Termination after Altercation with Internal Affairs Lieutenant he Pulled Over (Updated) | Photography is Not a Crime: PINAC

A Miami police officer pulled a car over for speeding last month, which turned out to be a plainclothes internal affairs lieutenant who shoved the door open on the officer after refusing to provide his drivers license, leading to a struggle on the side of the road that was caught on camera.

As the two were on the ground wresting, another three Miami cops who just happened to be in the area pulled up and piled on the screaming driver– only to pull off when they realized the man at the bottom was an internal affairs lieutenant from their own department.

That was when the officer Marcel Jackson, the cop who initiated the stop, was sent to his patrol car and internal affairs Lieutenant David Ramras assumed control of the situation.

Realizing the outranking officer with more than two decades of seniority over him was going to turn him into the aggressor, Jackson pulled out his cell phone and began taking photos of the officers that began arriving.

But then a cop ordered him to stop. And another cop later ordered him to delete the photos.

However, unknowing to the other officers at the time, Jackson had video recorded the entire incident with his GoPro camera, which he had attached to his dash, but shoved in between seat after realizing they were turning against him, keeping it recording to capture the ensuing conversations. The department does not use dash or body cams, so it’s not something they would expect.

Adding to the usual irony of cops investigating cops, the department’s internal affairs department is now investigating the incident involving their own lieutenant, who has since been transferred to the special investigations section, a top-secret unit that works in partnership with state and federal agencies, considered a promotion by officers in the department, even though it is technically a lateral transfer.

Jackson was fired over this and the lt. was promoted.

here's his gopro dashcam:

Target security officer fired after reporting shoplifting - The Washington Post

Dallas Northington spent nearly eight years working for Target in loss prevention, roaming the stores and scanning the surveillance cameras. In an episode at the Leesburg Target store in May that he said was typical, a man was allegedly captured twice on video shoplifting, and Northington responded as he said he always did: He called the Leesburg police, made a report and provided them the videos of the two incidents.

But the man in the video may have been a Fairfax County sheriff’s deputy, Northington said he soon learned. And within days, two things happened: The deputy retired from the sheriff’s office and Target fired Northington, 29, a married father of two with a third child on the way.

Northington said Target officials told him that he had violated procedure by not filling out the proper paperwork before contacting the police, though he said his office had operated the same way for years. He said he also was told that he had been insubordinate for not seeking approval before calling police, though he said the standard practice was for him to act as needed.

But the man Northington said he and his supervisors identified as a deputy has not yet been charged with a crime though Northington said he had provided the man’s name and two color videos of him in action, his face clearly visible, to Leesburg police on May 27, the date of the second incident.

Former Police Officer Says They Were Told to Stop & Frisk All Black Males Aged 15-30

In the summer of 2010, a young black man was stopped and questioned by police on the streets of Miami Gardens, Florida. According to the report filled out by the officer, he was “wearing gray sweatpants, a red hoodie and black gloves” giving the police “just cause” to question him. In the report, he was labeled a “suspicious person.”

He was an 11-year-old boy on his way to football practice.

A Fusion investigation has found that he was just one of 56,922 people who were stopped and questioned by Miami Gardens Police Department (MGPD) between 2008 and 2013. That’s the equivalent of more than half of the city’s population.

Not one of them was arrested.

Fabric and hardware stores were among his favored targets, and his penchant for linen shops, filled with bedding, earned him the nickname Pillow Pyro.

Man Finds FBI Tracking Device on Car, Posts Photos Online, Gets Visit From FBI | The Free Thought Project

https://www.miataturbo.net/attachmen...ine=1405430770

Silicon Valley resident Yasir Afifi recently discovered an FBI tracking device on his car when he took it for an oil change.

Alarmed and curious about what it might be, Yasir posted photos of the device online, asking members of reddit whether it was a bomb, or possibly an FBI tracking device.

In a short amount of time Yasir learned that it was in fact a GPS tracking device, and it was made by a company that only sells to government agencies.

Days later he was able to learn the direct source of the tracking device, when he was visited by a large group of FBI agents who had seen his posts online, and wanted their device back.

When he was visited by the agents, Yasir had obvious questions about the situation. Who had planted the device on his car, and why? Was he suspected in some sort of investigation?

The agents refused to answer any of his questions and told him that if he refused to cooperate with them that they were going to make this situation as difficult as possible for him.

there's a difference; dude almost drove away with a wife/children--so I can understand a little outrage and violence when trying to capture a grand theft kidnapper.

and they don't continually beat and taser him once he's down. and when he tries to resist they just keep him held down until they can handcuff him.

and notice how they can get the cuffs on without having to punch him in the face, break him arms, or even hit him with a baton to the kidneys.

A citizen hasn't been specifically trained for such situations, nor have most had formal hand-to-hand combat training, not to mention the litany of force multipliers available to "peace officers," seemingly used with impunity.

Also, other than the one guy stomping on his hand, this looked extremely reserved. They could have easily killed that guy. They only threw punches while he was trying to escape, and they pinned him down and held him until the cops showed up.

Like one of responses to one of the pearl-clutching YouTube commenters "I've seen cops beat women from behind worse than this. Here's an idea, don't commit crimes and you won't get shitty treatment."

Hypocrite?
I dunno.
Them citizen vigilantes are not sworn to uphold a lot of stuff and it is not their profession.
I have much figured that it is a whole different thing that one sworn to uphold the law to violate the law to enforce the law.
When the law keepers violate the law there is no law.

I did a citizens arrest once and explained rights to the punks > "You don't have any." And I went on to explain that I had right to hold them by any means I felt necessary until cops got there. Then they would have rights. ;)

Again - when there is not a little of the hypocrite in any of us then maybe it is time to apply for sainthood. ;)

Me too - but that cop has the extra obligation to uphold the Constitution and to not prejudge and mete out punishment.
Citizens are not trained how to deal with cops or criminals.
If cops administer some more bruises to *suspects* then I want the cops to not be cops and maybe do some time and fines as example for others.

Lawsuit aims to give right to film cops in public places
POSTED 11:24 PM, JULY 15, 2014, BY JAY DOW

NEW YORK (PIX11) – Debra Goodman knows her smartphone’s video camera like the back of her hand and won’t hesitate to record a random police encounter, from tough neighborhoods in the Bronx to her own Upper West Side.

“I wasn’t scared until I was arrested, and then I was pretty freaked out,” said Goodman. “They physically put the cuffs on me and they manhandled me, and threw me in the back of the truck like a piece of meat.”

Debra says things went south in a hurry on September 25th, when she began recording EMTS and two police officers attending to a disabled woman at the corner of Broadway and West 73rd street.

Debra is the plaintiff representing other police video documenters, in a federal lawsuit that seeks to give people the right – under the First Amendment – to record police officers working in public places.

That right already exists in several other cities, but there is no specific law on the books in New York.

While they haven’t seen the case, a spokesperson from the NYC Law Department issued a statement regarding the NYPD’s policy in bystanders filming police.

“Bystanders are allowed to film police officers as long they’re not interfering with the officers’ duties and/or police operations,” she said. “People are also allowed to film public officials with the same principles in mind.”

However, the Justice Department recognizes a citizen’s right to roll on the cops, writing in a 2012 memorandum,

“Officers should be advised not to threaten, intimidate, or otherwise discourage an individual from recording police officer enforcement activities or intentionally block or obstruct cameras or recording devices.”

“We’re pretty confident legally, especially with the precedent from the first, the seventy, the ninth, and eleventh court of appeals. Our sense is, this makes absolute sense. That as long as you’re not interfering with the police doing their job, why can’t you record it?” said Siegel.

Debra Goodman says her desire to turn ordinary walks into an exercise in law enforcement accountability, shouldn’t come with the gift of twenty five hours in custody…which is what she says happened following her own arrest.

“I think that we should try to affirm our right to have the right to film the police in public when they’re performing their duty,” said Goodman.

Hit-and-run victim investigates, solves own crime | wfaa.com Dallas - Fort Worth

The driver of a silver Volkswagen hit Rogers in the middle of the intersection. But, what happened next was even more surprising.

"So I'm still on my bike, and she forced her way through me," Rogers said.
The car pushed him aside and took off.

Rogers said he wasn't hurt seriously. He said he still feels some pain in his left foot, which was on the pedal that was struck by the car. Part of that pedal broke off, and Rogers said he couldn't find it.

A witness called the Smyrna Police Department and an officer came to the scene to fill out a report. The officer told Rogers it would be a day or two before a detective would be assigned to the case.

Rogers said he was so upset about the driver leaving that he didn't want to wait.

"I was not so much upset about the accident because accidents happen," he said. "I was upset that she pushed her way through and it was a hit and run."

The next day Rogers went back to the apartment complex the car pulled out of to look for a silver Volkswagen. He wasn't expecting much.

"The first car that I saw was a silver Volkswagen," he said. "I took a picture of it, and I thought, 'I'm going to check the front to see if there's any damage.'"

He took a picture of the car from behind and when he walked around to the front he found the missing piece from his bike pedal stuck in the grill of the car.

"The pedal sticking out was what really sealed it," Rogers said.

A police officer who lives in the apartment complex ran the car's license plate and found an address for the owner. Smyrna police arrested the driver, Pablynne Silva, 20, and charged her with a misdemeanor hit and run.

"Mr. Rogers solved the crime," said Officer Chris Graeff. "It's kind of rare, but he did a good job."

When police questioned Silva about what happened, she said, "I kinda hit a guy on a bike," according to an incident report.

When the officer asked her why she didn't stop, she stated because she was scared.

Police officer accused of driving drunk pulled over twice in one night | FOX8.com

An Ashtabula police officer was pulled over twice in one night under suspicion of driving under the influence before he was arrested.

Willoughby police received a call about a pickup driving erratically around 1 a.m. on June 21 near the intersection of SOM Center Road and Euclid Avenue.

Dash cam video shows a Willoughby officer began trailing the pickup before it pulled over in a Speedway parking lot. The Willoughby officer then learned that Ashtabula Police Patrolman Wayne Howell, Jr., 33 of Ashtabula, was behind the wheel.

Willoughby’s police chief said his officer did not conduct a field sobriety test or issue a written warning, but instead urged Howell, Jr. to get a ride home before leaving the scene.

“He felt the individual would get a ride home, but I wouldn’t trust anybody with something that important,” said Willoughby Police Chief Jack Beckwith.

About 20 minutes later, an Ohio State Highway Patrol trooper stopped Howell, Jr. on SR 44 in Concord Township and arrested him for operating a vehicle while intoxicated. The citation shows Howell, Jr. had a blood alcohol level of .159, nearly twice Ohio’s legal limit.

A glum-looking detective John Malloy, 46, pleaded not guilty to multiple counts of second-degree forgery and attempted petit larceny in Manhattan Supreme Court.

“There was indeed an unlawful firearm recovered in Brooklyn in in November 2012 [BUT]there was no tip that tied to that arrest,” said Assistant District Attorney Ryan Connors.

“The defendant used his position and forged several papers in attempt to claim the reward himself.”

Connors told Justice Ronald Zweibel that Malloy “forged the name and signature of his fellow detective so when it came to light, that detective was investigated for this crime.”

PA Heroes Stomp 17-Year-old Girl | Eric Peters Autos

https://www.miataturbo.net/attachmen...ine=1405687449

A teen’s evening excursion for ice cream resulted in her going to the hospital in a neck-brace, after police found her and her friends in public just a few minutes past the government-imposed curfew for minors.

The incident happened on Tuesday, July 15th, 2014, when 17-year-old Merceedez Wright and her friends decided to finish their evening with a stop for dessert.

It was just past 10:00 p.m., the hour in which the town of Clairton (pop. 6,700) had arbitrarily declared that people under the age of 18 must not be found in public under penalty of law. The ordinance (and all such curfews) directly violates the individuals’ right to travel and peaceably assemble.

...

Wright says she and her friends started walking away, but returned to pick up a purse and cell phone that had been left behind. Officers reportedly put her friend in a cruiser, and Wright says she tried to walk away, but was stopped by an officer.

Bryon Clifford, who witnessed the incident, said, “She kept walking. He got out, started chasing her, and once I seen her running around the corner about five seconds later, I hear her screaming at the top of her lungs.”

Wright says she admits that she ran from police saying she was scared by the way the officer got out of the car.

“They both just tackled me to the ground and smushed my face into the ground, and their feet and legs, and they start pulling my hair, pushing me and stuff,” Wright added.

Ms. Wright’s injuries were serious and she remains in the hospital. Her mom said that she’s experiencing problems with her lungs, among other things caused by the rough handling of the girl by police.

A disturbing glimpse into the shrouded world of the Texas grand jury system - Houston Chronicle

Appellate attorneys were so outraged by a 146-page transcript of Dockery's testimony before the 208th Harris County grand jury on April 21, 2003, that they entered it into the public record for judges to review.

In it, grand jurors don't just inquire. They interrogate. They intimidate. They appear to abandon their duty to serve as a check on overzealous government prosecution and instead join the team.

"Unbelievable," veteran criminal defense attorney Pat McCann said after I asked him to read the document. "When she went in there, Mr. Brown had an alibi. When they were finished browbeating her with her children, he didn't. That's the single biggest misuse and abuse of the grand jury system I have ever seen."

Rizzo and Lynn Hardaway with the DA's office declined comment, citing a state law that keeps grand jury proceedings secret.

Miami-Dade County taxpayers will pay $600,000 to the families of three men who were shot to death in a botched police sting in the Redland three years ago, despite police claims that the shootings were justified.

Without admitting liability, the county has agreed to pay $240,000 each to representatives of Antonio Andrew and Roger Gonzalez Sr., and $120,000 to the survivors of Jorge Lemus, according to documents provided today by the county attorney?s office. The family of a fourth man killed -- informant Rosendo Betancourt -- did not join in the settlement as they continue to press their wrongful death and civil rights lawsuit in federal court.
Apparently it doesn't look good to shoot 52 bullets into a person surrendering, shooting someone fleeing, shooting another person, surrendered, with his arms extended out, or killing your own informant that your force onto the scene despite the agreed terms, nor his distress signal, nor the fact that he was also surrendered himself, and then shot 23 times while laying unarmed on the ground.

Dallas officers shoot, kill homeowner who fatally shot burglar, police say | Dallas Morning News

Dallas police have confirmed that three officers shot and killed the homeowner who had fatally shot a burglar.

Officers responded to a call in the 10300 block of Plummer Drive in Far East Dallas. Witnesses said they saw a homeowner shoot and kill Jerry Hale in the alley. The suspect was evidently trying to break into the homeowner’s residence. Police arrived to find the armed man standing over the burglar’s body in an alley, police said.

They stopped an ambulance from entering the alley because the homeowner was still armed. Officers gave “loud verbal commands” to drop the gun. After he refused, they shot him multiple times, police said.

He died from his injuries. The homeowner has not been identified.

I don’t do snares. I don’t do dogs. I’ll shoot the <expletive> thing” and “I’m gonna shoot it anyway.” Approximately 20 minutes later, Police shot Lexie three times in front of the owner’s grandfather, who immediately refuted the Police claim that Lexie charged at them.

recurring theme: cops hate actually doing their jobs.

A 9 year old boy calls 911 several times but is unable to speak and just lets the phone line stay open. You can hear horrible verbal abuse going on in the background.

At one point you can even hear the mother and the boyfriend talk about how the 9 year old, Omaree, should be able to handle the type of physical abuse they have just dished out.

But when the dispatcher tries to tell the would-be responding officer, her pleas go unanswered.

According to KOAT, the 911 dispatcher told the officers that what she heard on the call was bad. She said, “You need to hear the 911 call to hear how bad it was. I can play it for you over the phone.”

Albuquerque Police Department Chief Allen Banks said the dispatcher was upset.

“Our dispatcher actually tries to reach out to the officer and say, ‘Hey, listen to this 911 tape. It’s disturbing. (It) sounds like verbal abuse.’ And the officer never listened to the 911″

Man Dials 9-1-1 to Report Home Invasion, It Goes to Voicemail. So He Shot them Himself | The Free Thought Project

A home invasion and robbery in Pasco County, Florida is exposing the myth of the 911 dispatch system.

It happened earlier this week on Gwain Road in Port Richey. A man called 911 after four robbers with guns broke into his home, demanded money and prescription drugs, according to My Fox Tampa.

The dispatcher tried to transfer the call from the fire department to law enforcement side of things – but he got a voicemail just as the crooks returned to the home.

Chaos ensues. Luckily this man takes matters into his own hands and shoots one of the robbers and the home invaders flee.

A common response to the question of “Why do you pay taxes?” usually includes something about roads, military, and police. The response is normally along the lines of, “well if we didn’t pay taxes, who would protect us and do the job of the police?”

Calif. Police Respond to Woman’s 911 Call…And Then Accidentally Shoot Her | Video | TheBlaze.com

San Diego police are under close scrutiny after accidentally shooting a homeowner who called 911 after allegedly seeing a man in a ski mask prowling the neighborhood.

While searching for the man, police entered the backyard of the woman’s home, San Diego County sheriff’s homicide Lt. Larry Nesbit explained. There, they made contact with the homeowner and, horrifyingly, shot her.

While police say Jennifer Orey was struck in the arm, her family maintains otherwise.

“You know what, you guys need to get your story straight,” Dennis Morgan, the woman’s father, admonished. “She wasn’t shot in the arm she was shot in the chest.”

Her sister-in-law added: “Part of a bullet ricocheted off and hit her in the pinky, and they also had to do a little bit of repair to her pinky as well.”

Orey successfully underwent surgery Monday, and is expected to be okay.

Phoenix Cops Shot Homeowner Tony Arambula Instead of Intruder - ABC News

When Tony Arambula managed to corner an armed intruder in his son's bedroom he expected police to come to his aid.

Instead, a Phoenix police officer confused Arambula for the intruder and shot him six times before realizing his mistake, a moment captured on the 911 call with a simple "F**k."

Even after realizing their mistake, Arambula said he was treated roughly, being dragged out of the house and transported briefly on the hood of a police car.

Now Arambula, 35, who survived but faces a lifetime of pain, is suing the city of Phoenix and the officers who responded to his house that night.

The lawsuit, filed in Maricopa County Court, alleges that Phoenix Police Officer Brian Lilly and his on-scene supervisor, Sgt. Sean Coutts, quickly conspired to cover up the mistake, not realizing that 911 was still recording Arambula's call for help.
