Yes they have. Under fraudulent conditions and sold as meeting all federal standards which they do not. VW has a legal obligation to fix this.

They can. They could force VW to do any number of things up to including a mandatory recall. Look, the cars don't meet the standards that all other cars are required to do. At some point, VW will be required to do everything in it's power to bring them into compliance which will include a recall.

VW will not want to implement a mandatory recall but in this case, because of the circumstances, the govt may force them too just to prove a point.

At some point you will want to sell your car (guessing you have one of the affected ones?). How do you expect to do that if it isn't updated?

And that's the problem.

On paper, it's already illegal to sell a car in most states if the emissions system has been tampered with. This isn't routinely enforced, but it would be relatively trivial for the DMV to implement a policy of running the VIN of any VW against a recall database whenever a title transfer is performed.

Things aren't getting any easier for them; VW developed 4 separate defeat devices over 7 years.

And notice how the Germans have mandated a recall in 2016; http://www.autoblog.com/2015/10/15/v...ecall-germany/.

We'll dick around testing the fix for a couple years before actually doing anything about it. Meanwhile, the world will have moved on...

So if I never sell my car, I will be fine? NM is a no-emissions-test state, with the exception of Bernalillo county. I have been wanting to do an exhaust and tune on it anyways, to get some more mpgeez and power. Since apparently it will be unsellable or something, I should just keep it and make more power lol.

A forced recall while possible, I have my doubts on it actually happening(or hopes maybe). Unless there is a penalty from the government, it will be really, really, REALLY hard to enforce.

Yeah, it would be easy to enforce in Nazifornia, but I don't know about other places. I really want to follow your path and do the full exhaust and tune to make my TDI fun to drive. I also can't wait until you decide to tow the Miata with your Sportwagen and report back!

What kind of maintenance schedule have you followed with yours? You are above 100k now right? I just rolled past 50k and the Service warning is on now for the oil change.
