That's such a fake charge to begin with. We should be outing all the congressmen who voted against the first amendment in that case.

The republican party is severely fractured by the plethora of democrats who still reside within the party.

The entire country should be outing the congressmen who doctored evidence and submitted it [and retracted some] in a sham trail. And then maybe audit the election -- you know, for unity. But question law violations [ like the 20-something stats that violated chain of custody laws to name one] and unexplainable things is a disease, so I digress.

I think they should be charged with Insurrection, sedition, treason, etc. Ignoring and defiling the Constitution should be punishable, not to mention them desecrating Trump's 5th amendment rights.

You feel that the impeachment of a former President poses a threat to his life, liberty or property? Or merely that following the following the rules laid out in the constitution for conducting an impeachment does not count as due process?

I hold that the 5th and the 14th refer specifically to the deprivation of life, liberty, or property. So, if this had been a regular criminal trial, there might be some standing there, if it could also be demonstrated that due process was not afforded. That does not appear to be the case.

Moreover, the remedies available at an impeachment do not include execution, imprisonment or forfeiture, which are the specific penalties for which the due process clauses apply. The outcome of a conviction at impeachment is limited to removal from office, and prohibition from holding office in the future.


Also, curious as to what you mean by a "non-crime." Insurrection is a crime all by itself, and Section 3 of the 14th Amendment states:

No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may, by a vote of two-thirds of each House, remove such disability.

That would be removal of a constitutional right, due process applys, or should. Hard to say in our current clown world.

"incitement of insurrection" isn't a criminal charge that should exist in this country our founding fathers would be disgusted. The freedom of speech is absolute, therfore "incitement of insurrection" is a non-crime. If Trump had stormed the capital himself for his mostly peaceful protest, maybe you would have a argument.

The impeachment managers used terms like "overthrow the duly elected government" and "sedition", but it's not like playing capture the flag. If you want to "take" power, you have to be able to hold it. All those gun-loving, bible-thumping Trump supporters appear to have left their AR-15s at home.
