As a non-Distributor, a reseller has only to satisfy their own business ethics requirements, whatever they may be.
SPS's policy regarding our 'Wholesale Partner' network (these are customers who not only purchase in quantity, but that we have qualified as 'legitimate' resellers) is simple, and we not only believe it's fair, but we reserve the right to enforce it.
If a Wholesale Partner violates a policy (such as MAP), we contact them, point out the issue, and give them a reasonable time to correct the issue. If it's not corrected, we simply remove the discount that allows them to sell at or above MAP. Effectively, this takes away the ability for that offending party to compete in the marketplace.
We, as a company, have the responsibility to protect the integrity of the product and the Distribution chain. Fortunately, we have not been forced to take that step often, but it has happened, and we don't relish it, but we have also simply cut some customers off from purchasing product from us completely.
In this particular case, Himni was contacted as soon as we were made aware of this issue, and a similar timeline for resolution was required, with similar consequences. At this time, they have complied, in that they've contacted Soviet with an offer for resolution.
We will continue to leave our offer on the table to Soviet, until such time as his issue is resolved, whether that resolution comes directly from us, or through Himni Racing.
I can assure all who are following this thread that this issue is not taken lightly at the factory level, and that everyone involved are ready to solve this problem.

I'd like to thank Mike for bringing this situation to my attention. My name is Paul & I am the owner of HR. I have brought myself up to date regarding the details surrounding this matter & would like to touch base on Soviet's situation & to clear up concerns & misconceptions.
I have confirmed that an individual employed at HR did in fact provide Soviet with some incorrect information regarding his required warranty. The information they passed to Soviet was data given to them by one of our venders that they believed to be our suppler for the turbo in question. They were incorrect & did in fact contact the wrong source on this unit. We use multiple venders for a given product based on availability & demand. This in no way however justifies passing the incorrect info to a consumer & for this, HR takes for responsibility for that error. It was NOT an intentional attempt to mislead Soviet in any way & WAS an honest mistake on his part but, HR still does NOT condone providing incorrect data, no matter the source or circumstances.
Next & equally important, in NO way did the individual in question or HR as a whole ever recommend a GTX unit for the purpose of financial gain or to "make a sale." This simply is not the case. The unit was offered at a discount, meaning our cost/what we pay & was done so strictly as service to Soviet, when they were under the incorrect impression that BW was not going to honer a warranty. It is standard HR practice to offer other services & solutions to our consumers as needed to achieve customer satisfaction. It was a kind jester & incorrectly manipulated into a negative. The EFR was not offered as a discounted alternative due to very limited availability & We do not promote one brand over the another as being "better" or superior. Again simply offered do to product availability only.
Contrary to what has been stated, HR does handle any warranty needed by our customers. We have a strict guidelines in place that outlines procedure for a given brand. In the rare event that a BW unit requires a warranty, the unit is returned to us to for a visual inspection. It is then passed on to the an authorized OTS warranty center. Once a warranty has been authorized, the repaired of replaced unit is directed back to us, then to our customer. HR's stand always has been & will always be, that we welcome any warranty as an opportunity to provide our consumers with relationship building customer service. It's not only good for the brand & the consumer but benefits all parties involved including ourselves. With that said, Soviet did not directly purchase his unit from us. However it is my understanding that he obtained it from a friend that is an HR customer & therefore why we offered to help in the 1st place. It is also worth noting that the HR employe did in fact offer to still submit the unit for warranty as seen in the email displayed on a prior page.
In light of this matter, HR has put some new things in placed to insure these type of misunderstandings do not happen in the future. First, the employee in question is no longer with as due to the domino effect his incorrect data has caused. Secondly, ALL warranties, no matter the brand, will be personally handled be myself, effective as of 8/3/2012. Borg Warner manufactures some of the very best turbos in the world that are nothing short of amazing, in all aspects including function, performance, durability & follow up service. HR's comment to you is that we will only offer the very best products on the market & as always, look forward to providing our consumers with the outstanding service they deserve. Once again, my apologies to you Soviet & if there is anything we can do for you in the future to make good on this misunderstanding, please just let me know.

I just wanted to state clearly that, since 07/28, after being made aware of this issue, Himni Racing has been in constant contact with both our company and with the end user, and is working to help resolve this issue.

I ran it real quick on BW calculator, looks like if he can open the head up more and get more flow at the same boost numbers he should be able to make a significant gain on the top end. But that was on some real conjecture since I basically reverse engineered his setup from his torque curve.

I ran it real quick on BW calculator, looks like if he can open the head up more and get more flow at the same boost numbers he should be able to make a significant gain on the top end. But that was on some real conjecture since I basically reverse engineered his setup from his torque curve.
