SAVANNAH, GA — Yet another innocent couple was jarred from their beds to the sounds of explosions, glass breaking, and armed men crashing through their door. As armed men broke into their windows and doors, invading their bedroom, they thought that they were being robbed by a criminal gang.

Michael Hall and his wife were awoken Thursday morning at 4:00 AM to the sounds of violent entry into their home. They both thought that they were being robbed.

But it wasn’t a robbery. They were experiencing first-hand one of the tens of thousands of SWAT raids that occur annually in the U.S. per year. As many are, this one was a no-knock (no warning) raid.

“We heard a kaboom, and after that we jumped up out of the bed and police are screaming: ‘get down, get down get down,’” Hall told WTOC.

The paramilitary team had breached not only his front door, which was splintered into pieces, but also simultaneously breached four windows, perhaps for dramatic effect.

“They stayed in there about two, maybe three minutes, searching the house, saying: ‘clear room one; clear room two; clear room three; clear room four’. At that time the SWAT team left, after they cleared the house,” Hall said.

Mr. and Mrs. Hall only had enough time to stumble out of bed before they were taken to the ground by SWAT agents and forced into plastic handcuffs.

Before leaving, the Halls were questioned about a man they never heard of. Police were looking for a 20-year-old gang member named Jashavious Keel, who had never lived at the address.

The Halls had come within inches of their lives over a mistake. Any SWAT raid can easily turn into a tragedy, with the possibility of one false move being interpreted by an edgy cop as an act of aggression.

The rise of SWAT teams nationwide, the number of annual SWAT deployments in the U.S., has gone from a few hundred in the ’70s, to 30,000 per year in the early ’80s, to 50,000 in 2005. That’s 100, 150 times a day in this country you have these heavily armed police teams breaking into homes, and the vast majority of times it’s to enforce laws against consensual crimes.

Imagine going from sound asleep, to racing your loved ones into a closet, to getting gunned down in your house in 38 seconds. That’s not a lot of time to comprehend the situation, verify the threats, or understand the implications. A bunch of muffled screams and banging sounds could just as easily be a criminal gang as it could be a SWAT team. With only seconds to react, a frightened father has the choice of either presuming the intruders are criminal home invaders and picking up a gun, or presuming the intruders are wearing from the government and sticking his hands in the air. Its a lose-lose situation if a homeowner makes the wrong split-second assumption in a groggy attempt to rationalize the situation. Guerena, being an innocent man and having the responsibility of protecting his family, presumed the aggression at his door was not from friendly sources, and picked up his rifle.

I gave up on hope for this country a long time ago. I don't think it will change, because people don't seem to care enough to do anything about it. If I could afford to move away to another country, I would have done so a long time ago. I'm embarrassed to tell people from other countries that I'm from here. It's no wonder most of the civilized world hates us and thinks we are all insane, because apparently we are for letting this kind of shit happen every day. But we are the greatest, USA! USA! USA! The only part of this country worth saving is the land. The government and people are a lost cause.

JONES COUNTY, GA — A woman says that her ten-month old puppy was shot in the head after asking officers not to shoot it — twice.

On September 22, Anna “Chrissy” Music-Peed, of Macon, GA, drove to the Jones County Sheriff’s Department to request an officer come to and investigate a vehicle that had been brought to her property by an acquaintance, that both she and her roommate strongly suspected to have been stolen. Music told policestateusa.com that it was a Nissan Xterra from Virginia Beach, VA. As Music wrote in a blog post, “I will not have that influence around my family,” saying she was trying to do the right thing by making a report. The acquaintance was still on the property and Music had not let on that she had gone to talk to the police.

Music wrote on that while she was providing officers with details of the stolen property, and the individual who had brought it over, she also explicitly told the police not to shoot her dogs.

“The puppy may jump, we have been trying to get her out of that,” Music explained, stating that the dogs were friendly puppies. She said the officers laughed and told her not to worry about it. Unconvinced, she emphasized again: “PLEASE don’t shoot my dogs, they are my babies.”

About 5 minutes later is when the sheriffs pulled up, came flying in. Sgt Little was exiting the vehicle and as he was exiting I noticed he already had his sidearm trained on Ammo who was just sniffing around the ground wagging her tail. So, I just found this thread, and frankly, this is terrifying.
Recent years events (US politics external and internal) has made me reconsider my former thoughts of moving to the states.

What I see here is obviously events from a huge country, but they are still too many, Is this on a national scale? or is shit like this happening all over? I've always loved north cal, and I have problems picturing stuff like this happening there.

Now, over here (in what you call socialist sweden, somewhat misinformed ;) ) there is some serious medial heat every time an officer fires his gun improperly, and in many cases even properly. (There is a fairly recent incident of a jewelry store robber who was shot in the head whilst pointing a fake ak47 at a cop. Medial response was along the lines of "the carbine was fake, why did you go for the head". But the officer was quickly found free of guilt).
Now, obviously, we are not allowed to concealed carry, there is a criminal record investigation if you buy a gun, and in order to own a pistol, you need to have a license and gun club membership. That makes guns a lot less common and I'd like to think that it makes our officers less jumpy. We are also less than 1/20th as many as you are, but hey, something is really, really broken in your system.

Government bullies are taking the little guy's milk money.

Earlier this year, without warning, the federal government seized the store's entire bank account—more than $35,000—and refuses to give it back. The government falsely accused Terry and Sandy of breaking anti-money-laundering laws by making frequent bank deposits of their store's cash receipts. But they did nothing illegal and have been charged with no crime. In July, the government filed a lawsuit to keep the money, not against Terry and Sandy but against the cash itself, which is why the case has the bizarre title of United States v. $35,651.11.

Federal civil forfeiture law features an appalling lack of due process: there is no way to quickly get a ruling from a neutral decisionmaker about the validity of the government's seizure, and therefore Terry and Sandy must do battle in federal court against the U.S. Department of Justice to prove themselves innocent and get their money back. Shockingly, the money taken by the government will be used to fund the budgets of the very federal agencies that seized the money in the first place.

On September 25, 2013, Terry and Sandy teamed up with the Institute for Justice to fight back. A victory for Terry and Sandy will vindicate not just their right to be free from abusive forfeiture tactics, but the right of every American not to have their property taken from them by government when they have done nothing wrong.

The problem is government intervention. I'll explain:
1.Government intervention in Gun control is a problem.
2.Government intervention in education is a problem.
3.Government intervention in health care is a problem.
4.Government intervention in police training isn't necessarily a problem. Government style leadership of the police force is.
5.Government intervention in the legal system is a problem

Do you see the trend?
Here are the solutions:
1. The government must repeal most laws on gun control.
2. The government must repeal all laws on education
3. The government must repeal all laws on health care.
4. The police must separate themselves from influence of "the government". They think they are "hand of government first, servants to the public second" - this is incorrect.
5. The government must stop trying to change the legal system.

Since the formation of our congress, members of congress have had the easiest jobs in the world: Go to work and make sure nothing changes. Somehow they f*cked that up. Regarding the police: I'm not saying they should be a private force, but when the police get to decide what laws should/shouldn't apply to them, and our checks and balances system doesn't apply to them - that's when the police force gets out of hand. There needs to be a division of the legislative branch who's sole purpose is investigating and prosecuting government crimes against civilians.

All of the above, including "profit motive" in the legal system. See earlier commentary on the criminal forfeiture laws. Add to that the "war on drugs" and for-profit incarceration system.

The militarization of our police force is turning cops in to soldiers and soldiers face enemy combatants. Who are the enemies combatants? Any non-cop.

It mainly affects my life in that I have zero trust of police officers and treat them with intense fear and loathing, rather than respect. I am courteous to cops because I firmly believe they can beat me or my wife to death and suffer almost no consequences for it. They can definitely kill my dogs and not even face a verbal reprimand.

I live in the same state that a lot of those video clips are from (Florida). Our sherriff's spokesperson is the one who said, discussing the hiring of war veterans, that they are a "paramilitary" organization.

After finding a small amount of forbidden plants in the vehicle, officers weren't satisfied. They wanted more. The two women, dressed only in bikinis, were told they were going to get an internal body cavity search.

"Are you serious," Brandy Hamilton asked the trooper.

"If you hid something in there, we're going to find it," said the trooper.

"You're going to go up my private parts?!" Hamilton said.

"Yes ma'am."

The women say that the same glove was used to violate all of their orifices.

I would also argue that using dynamic, forced-entry tactics to serve search warrants on people suspected of consensual crimes is actually more dangerous than, say, waiting for your suspect to leave the house or apprehending him during a traffic stop. You're creating violence and confrontation. SWAT teams were once used to save lives when a violent person had put them at risk. Today, they're primarily used in a way that puts lives at risk.

Liberty Tax Service doesn't let just anyone don its trademark Lady Liberty costume and dance for potential tax customers. There are tryouts and specialized training on proper singing, dancing and waving techniques. A lot of dreams are crushed.
Channing Gould was one of the lucky ones. A 19-year-old performing arts student at Tarrant County College and aspiring hip hop artist, he earned the right to stand in front of the Liberty Tax franchise on North Tarrant Parkway in Fort Worth. And then, seven months ago, he lost it.

The story made national headlines. Gould was dancing on the median in the 4800 block of North Tarrant Parkway on March 11 when he was approached by Fort Worth police. Told that he was disrupting traffic in violation of city ordinance, Gould was asked to leave the narrow strip of grass. When Gould also refused to get into the back of the squad car, the cop took down Lady Liberty with a Taser.

It was a mortifying experience for Gould, but it wasn't the last humiliation he would suffer Fort Worth's criminal justice system. WFAA's Teresa Woodard caught up with Gould last night.

"I'm an innocent Tax Liberty guy," he told Woodard. "I was dancing. That's what I do. I dance."

It's true. Gould's innocence was formally established when Tarrant County prosecutors recently dismissed his resisting arrest charge, but only after a suitable punishment.

"I had to write 52 times on a board that I would not argue with police in order to get a dismissal," Gould said. "In front of the judge and witnesses that were there, I signed it. I even made it colorful for them and all that...I felt like Bart Simpson."

That'll teach him to dress up like a woman and go dancing in Cowtown.

I don’t need to write lines upon lines of words to explain this video. Just look take a look at it and then make your mind up on how trigger happy police work. The dog in the video wasn’t aggressive. Wasn’t biting anyone. It certainly wasn’t out of control. Turns out the owner of the dog had a neighbour who didn’t exactly get along so the neighbour called the cops to falsely report an out of control dog. As a result the cops shot the dog in the head for no reason. If you didn’t see it, all them cops had their stun guns withdrew. Instead they decide to kill it using a gun.

Cops Kill A Disabled Iraq War Vet In His Own Home - The Free Patriot


LYNN, Mass. – A disabled Iraq war veteran was shot and killed after police claim he grabbed an officer’s gun inside his apartment.

Lynn Police Chief Kevin Coppinger said officers were responding to reports of a disturbance. They allege the suspect, Denis Reynoso, got into a heated exchange with a person in a gray car before returning to his residence.

Investigators claim three officers entered Reynoso’s apartment where he wrestled a gun away from one of the officers.

“A physical struggle ensued during that struggle it appears that individual was able to take one of the firearms from one of the police officers and shots were fired in the apartment,” said Coppinger.

Reynoso was rushed to a nearby hospital where he died from his injuries.

Family members claim the Iraq War veteran was caring for one of his two children during the shooting. They say he would never try to grab a gun from a police officer.

“You took him from two beautiful children and a wife, and a sister, and a mother, and everybody,” said Reynoso’s wife, Jessica Spinney.

Spinney says she disagrees with the police version of the story.

“Do you think a disabled veteran from Iraq would reach for another officer’s pistol? Never in a million years,” Spinney said.

The district attorney “will conduct an investigation of the use of fatal force as is protocol,” office spokeswoman Carrie Kimball-Monahan said. Findings of the investigation will be made available to the public.

When Mr. Singh explained that he was a Sikh and that the kirpan was a sacred religious article, the officers laughed at him and mocked his religious beliefs. They continued to taunt him, and forced Mr. Singh to circle his truck with his hands on his turban while they searched the vehicle. Mr. Singh's ordeal did not end with the MDOT. When he returned to Mississippi on March 26, 2013, for his court date at the Pike County Justice Court, he once again suffered humiliation, harassment, and discrimination because of his religious beliefs. Waiting for his attorney in the back of the courtroom, he was stunned when four Highway Patrol officers approached him and ordered him to leave the courtroom. The officers stated that Judge Aubrey Rimes had ordered them to eject Mr. Singh from the courtroom because he did not like Mr. Singh's turban. Moreover, they told Mr. Singh that Judge Rimes would punish him if he failed to remove his headdress.

When Mr. Singh's attorney went to Judge Rimes's chambers to inquire about the matter, he readily confirmed that he had expelled Mr. Singh from the courtroom because of his turban. He further stated that Mr. Singh would not be allowed to re-enter the courtroom unless he removed "that rag" from his head and threatened to call Mr. Singh last on the docket if he continued to wear the religious headdress...

Opelousas teen claims illegal search, harassment - Acadiana's Multi-Media News Station


Alexis Ahart, 16-year-old Opelousas resident, says she was home alone last Wednesday when Opelousas Deputy Marshal Frank Angelle Sr. barged into her house without a warrant, taking photographs and sifting through the house.

"He opened the door and started taking pictures and flinging things down and I'd asked him what was going on and he said he was doing police business," says Ahart.

She also claims Deputy Marshal Angelle laid hands on her when she tried to use her cellphone to record what he was doing inside her house.

"He pushed me up against the wall that is to the right of me and he kept on embracing me back and he got in my face spit in my face he took my phone twisted it out of my arm and deleted the pictures and screamed at me basically threatened me," says Ahart.

Ahart says these photos were taken the evening of the incident before she went to the hospital and according to this report from Opelousas General she was diagnosed with a sprained wrist.

Now her father Michael Ahart is getting Marshal Paul Mouton involved.

Michael Ahart confronted Mouton last Friday, but was unable to lodge a complaint, until this Thursday when we showed up at the Marshal's Office with the incident report.""

So far, situation mildly screwed up, but more or less normal--accidents happen. It's what comes next that is surprising*. And deplorable*.

The officer gets out of his car*, appears to talk to the injured pedestrian*, and then gets back in the cruiser and drives off*.

Later, the pedestrian makes a call to 911*, corroborated by another woman's call minutes after*. In it, the pedestrian tells his simple, but uniquely Floridian, story*.

Cook County Sheriff Tom Dart detains people even after they've been acquitted and it could cost taxpayers millions | WBEZ 91.5 Chicago


Brian Otero spent nearly two years in Cook County Jail waiting to go to trial for a burglary. The jury found him not guilty, but he didn’t get to leave the courtroom like they do on TV. No, he was brought back into the Cook County Jail to be “processed” out. He was put in a small cell just off the front of the courtroom, to eventually be brought back into the jail.

Now remember, at this point, there are no charges against Otero, yet he’s being detained against his will because that’s just how we’ve always done it in Cook County. Defendants who have been held in jail awaiting trial are brought back into the jail. They can be handcuffed, searched, and locked back up in their cell even though there are no charges against them.

Sheriff Tom Dart and county officials are doing little to change the seemingly unconstitutional practice and that could cost taxpayers millions...

A Virgin America passenger is suing the airline for $500,000 after being detained by federal agents following an in-flight tiff. After his soft-drink order went awry, flight attendants reported to the police that the passenger went to the lavatory, cursed, and left the toilet unflushed.

The passenger had little other interaction with the crew, but when the plane landed at San Francisco International, he was pulled aside and taken into custody by airport police and federal agents, the lawsuit states.

An incident report filed by San Francisco police shows authorities were called to the scene because the flight crew complained to the pilot that Bevivino was using profanities and not listening to instructions.

A flight attendant told police Bevivino said, “My time is precious, you are here to serve me,” and that he later used the lavatory but did not flush the toilet, according to the incident report.

The incident took place in June after Castellani was kicked out of a casino for being underage. The video shows he was exchanging words with cops from down the street when they came charging at him and attacked like a pack of rabid dogs.

The police officers in this video must either be extremely dumb or completely untrained. Using a stun gun (taser) against anyone can have deadly consequences like the 20 year old in a vegetative state found out because she ran from a cop. It looks like the man in this video was extremely drunk and the police had been called to move him from a property. You’ll notice he’s already in handcuffs and I fail to see what threat he posed to the officers, but still that doesn’t stop them from constantly tasering, kicking, punching at screaming at him.

I don’t see why the police had to handle this situation in the way they did. If someone you’re arresting is in handcuffs then the chances are they no longer pose a threat (unless they’re a ninja of course) so why on earth do the police officers have to beat this guy to a pulp? Because they know they can get away with doing so. All they have to say is something like ‘he was being uncooperative and I felt my life was in danger’ – that’s usually the exact words all officers say when they’re asked a question like ‘why did you kill that guy?’ or ‘why did you beat that guy up?’.

Again, the police show up in big numbers for this one man that wasn’t even fighting he was simply drunk and couldn’t stand up.

AUSTIN -- An Austin police officer has been fired for shooting at a driver during a traffic stop.
On Friday, Chief Art Acevedo said the shooting was unreasonable, especially the way the officer acted after he fired his gun, but the civil rights attorney handling the case says his termination is not enough.

Dash camera video shows what happened after James Barton was pulled over at 12th Street and Airport for running a red light back in May.
"Stay in the car. Stay in the car. Stay in the car," yelled Austin Police Department Officer Justin Boehm, who fired one shot as Barton stepped outside of the car.
It cost Officer Boehm his job.

"It was not reasonable and therefore under our policies the only appropriate discipline is indefinite suspension," Acevedo said.

The Chicago Police Ruined John Collins' Life


Seven years ago John Collins was charged with aggravated battery of a police officer, a felony in Illinois. He was sent to a Cook County jail and bond was set at $75,000, which he could not pay. The jail was overcrowded, so Collins slept on the floor. He remained there for 385 days, during which time he missed the birth of his first child, a baby boy. His fiancé brought his infant son to visit but he was not allowed to hold him, separated by a pane of glass. Sometimes, those visits were canceled “ when the jail was put on lock-down for stabbings and murders.” Eventually, his fiancé left him, saying his time in the jail had changed him — he wasn’t the same person anymore.

Today Collins is a free man, acquitted of all charges, and the Chicago Police owe him $1 million. His seven-year odyssey may have finally ended this week, when a jury unanimously found the two officers involved guilty of malicious prosecution for fabricating the case against him.

STOCKTON, Calif. (CN) - School district police Tasered and beat the hell out of an innocent man, giving him a heart attack, after getting a report that some other guy had a gun seven blocks away, the man claims in court.
Danny Nessen Jr. sued Stockton Unified School District and its police Officers Miguel Hinojosa, Thomas Giles, Brett Grawet and Mario Gates, in San Joaquin County Court.

Nessen says in the lawsuit that he was walking from his father's house to his grandfather's house on Oct. 4, 2012 when Sgt. Kimberly Pinto pulled alongside him in a police cruiser, pointed her gun at him and ordered him to the ground. This was because "defendants had received a call that a man with a gun was at the School for Adults some seven (7) blocks away," according to the complaint.

Sgt. Pinto died in an incident unrelated to this event and is therefore not a party to the lawsuit.
The defendant officers arrived soon after Pinto confronted Nessen, according to the complaint.
"Without making any attempt at identification or verifying that plaintiff was the man with a gun, defendants, some with their guns drawn, ordered plaintiff to put his face down into the grass and hands behind his back to be handcuffed," the complaint states.

Nessen says he obeyed the officers' orders, and that two of them got on top of him to handcuff him, he couldn't breathe and lifted up his face to get some air.

"Defendants then Tasered him numerous times," the complaint states. "During this struggle, plaintiff was struck in the head area ten to fifteen times by defendant Giles, who was sitting on him at the time. Plaintiff's head was pushed into the grass numerous times and his hair was pulled back. Additionally, plaintiff was struck by batons and the feet and fists of the defendants. Twice on the right arm, plaintiff was struck by defendant Hinojosa's baton. Eventually, plaintiff was handcuffed.

"Toward the end of this process, plaintiff vomited and then went into cardiac arrest. American Medical Response arrived and was able to resuscitate plaintiff. Plaintiff was transported to St. Joseph's Medical Center, where he spent two (2) days while on a breathing tube. After he was released from the hospital he was arrested by the defendants and spent sixty-six (66) days in jail before he was able to obtain his release by posting bail."

Nessen claims the officers had no reason to attack him, as he was unarmed and never posed a threat to them throughout the incident.

He claims the school district fails to properly train its police officers and has a policy of refusing to investigate its officers' actions, allowing them to file false police reports to get away with misconduct.

Jennifer Dodge, executive assistant to Stockton Unified School District's Superintendent Steve Lowder, said Lowder does not "make a habit of commenting on pending litigation." The school district's media spokesman was out of the office Thursday and today.

Nessen seeks compensatory and punitive damages for battery, false imprisonment and intentional and negligent infliction of emotional distress.

CHEHALIS – A 68-year-old Chehalis man has contacted an attorney after retrieving his dog from the city animal shelter and finding it had a broken jaw.

Bruce Beauregard is both steaming mad and broken hearted about his 6-year-old Dachshund-mix he called Rowdy.

Beauregard was alarmed when the police officer sent to collect his pet said the dog was aggressive so he “offered him his boot” and then horrified when he saw his dog sitting in the kennel with his head hanging down and his face smashed up. He said he was afraid to look closely, but when he rushed to his veterinarian, his fears were confirmed.

“The poor little guy, he couldn’t even lick me or lick my face,” he said.

The 16-pound dog was euthanized the same day.

Rowdy’s stay in the city’s temporary animal holding facility at the end of last month was unplanned. It began the evening of Aug. 23 when Beauregard was pulled over by a Chehalis police officer for weaving down South Market Boulevard and arrested for drunk driving.

According to the police report, the small dog in his truck was very aggressive when a second officer came to take the dog away.

Chief Schaffer points out the two officers got Beauregard out of the back of the patrol car and out of his handcuffs so he could assist in moving the dog. Beauregard said he helped them leash and muzzle Rowdy who was understandably upset.

“He was very protective of me, and didn’t like strangers handling me,” he said.

He said he warned them his pet wouldn’t like going to a kennel, wouldn’t be happy and wouldn’t eat.

Rowdy was taken to the city’s shelter off Kresky Avenue and after the officer finished getting breath samples and filling out paperwork, Beauregard was given his citation and then a ride to his home.

He tried to pick his dog up the following day, he said, but was told he had to wait until Monday morning.

Beauregard’s longtime buddy Scott Fanning who went with him described the same kind of puzzlement and apprehension when Officer Thompson addressed the men before opening the shelter door.

“He said, he was pretty aggressive when I was trying to get him. He was attacking me so I offered him my right boot,” Fanning said.

Once they got inside, they saw Rowdy with blood on his face, his jaw hanging and one tooth bent outward.

The officer was saying he thought the dog’s tooth was hurt and Beauregard was getting hot, asking who did it, who was taking care of his dog, Fanning said. Thompson replied he didn’t know, he said.

Fanning hustled his friend and the dog out the door and to the veterinary office, he said.

Two weeks later, Fanning said he still gets sick thinking about what transpired between a “big cop and a little dog”.

“I’m still crying, I can’t take it,” Fanning said. “He was one of my dog’s best friends.”

COLLINSVILLE, IL (KPLR)– The city of Collinsville and a police officer are slapped with a federal lawsuit after a traffic stop on Interstate 70.

The plaintiff’s say a Collinsville officer unlawfully searched their car. Their attorney says they have the dash camera video to proves it.

The lawsuit centers around two Ohio men visiting the Star Trek convention at the St. Louis Science Center in December.

On their way out of town the men were pulled over allegedly for swerving.

Their attorney says this video proves the officer violated his client’s constitutional rights.

Filmmaker Terrance Huff calls his edited dash cam video “Breakfast in Collinsville.”

Huff and a friend were pulled over on Interstate 70 last December.

Collinsville Police Officer Michael Reichert explains why Huff was stopped. “You were in a lane near a truck and then you went half way over the lane,” he stated.

Huff is handed a warning. He should have been free to go.

Officer Reichert then tells Huff a little marijuana isn’t a problem. But Reichert brings out his K-9 and takes him to the front of the car out of the camera view.

Huff’s attorney says Officer Reichert coached the K-9 to respond to a false positive. No drugs were found in the car.
The video has caught the attention of attorneys across the country. Mick Henderson isn’t working on this case, but defends similar clients in the St. Louis area.

He’ll be watching what happens in federal court.

See, that is the worst part to me. these things are going to happen. Police are only human, and we are all prone to that primal pack mentality that makes some of us go wild in situations where testosterone if flowing. But there should be a way to hold these fuckers accountable, and actually be able to punish them. These actions are fully criminal and disgusting, yet likely the most punishment any of them will see will maybe be suspension without pay for a few days or something. They are supposed to work for us, but they all work for each other, and have each others back, even when they are fully in the wrong.

Florida: Police Sergeant Fired Over Bogus DUI Arrest


Police in Tampa, Florida on Friday fired Sergeant Ray Fernandez over his role in a bogus arrest of a prominent lawyer for driving under the influence of alcohol (DUI). Tampa officers arrested C. Philip Campbell Jr on January 23, just two weeks into the high-profile defamation trial between prominent radio show hosts Bubba the Love Sponge and Todd MJ Schnitt. Campbell represented Schnitt, and rival attorney Adam Filthaut represented Bubba the Love Sponge.

Filthaut was a good friend of Sergeant Fernandez and godfather of one of his children. On January 23, Filthaut called Sergeant Fernandez and soon thereafter the DUI unit supervisor began a stakeout of Malio's Prime Steakhouse, where Campbell regularly eats. As it is just two blocks away from his condo and near his work, Campbell walks. An investigation by the state attorney's office concluded that Campbell had been set up for this DUI arrest by police colluding with the rival law firm...

That means that Olejnik and Duran could still be held in criminal contempt of court and be sent back to prison. And according the the Free Press, a fellow grand jury resister known as Steve is still being harassed and threatened by law enforcement for refusing to participate:

In the past week, Steve has been experiencing multiple instances of police harassment; harassment to the degree he has not experienced before. About two weeks ago at one in the morning, while walking to the corner store, Steve was approached by two local police officers who screamed his name and threw him against their car and into the backseat.

The cops went as far as to [say] they would beat him and leave him out where no one could find him. Eventually the police stopped the car in an industrial park on the outskirts of the city. They then removed Steve from the car and stole his cellphone, jacket, shoes, and emptied his wallet of personal items and money. The cops then left him there. Police Pepper Spray, Arrest Father Of Dying Teen For Yelling At First Responders Who Allowed Her Body To Roll Off A Gurney As She Died : Personal Liberty


As his teenage daughter lay dying from a self-inflicted gunshot wound, a Joplin, Mo., man and his son were pepper sprayed by local police and taken to jail, where they were handcuffed to a bench for being upset.

When emergency personnel arrived on the scene, the understandably upset family hoped that there was some chance Brooke’s life would be saved, but the teen’s condition and the entire situation rapidly took a turn for the worse.
“To me, time was everything. I was going, ‘Let’s go, get her to the hospital, hurry up, hurry up,’” Kevin Russell told KSPR.

The father said that things then became much worse.

The first responder turned away from Brooke to her father to ask what had happened. That’s when, as her father looked on in disbelief, the teen’s body rolled off the gurney on which she had been placed.

Next, the family alleges, some badged, pepper spray-wielding thugs saw the need to intervene.

“I started screaming and said, ‘Do your f-ing job, get her to the hospital,’ and the EMT put his finger in my face and said, ‘Calm down, sir.’ I was screaming, ‘Please get her to the hospital.’ And right about that time a police officer ran up on the sidewalk and I saw Brant go down.”

The father and son were quickly pepper sprayed by police and arrested.

“I was on the pavement, I couldn’t breathe and another officer put a knee in my back and told me to get up and he said if I didn’t get up he was going to Tase me,” Brant Russell said of the takedown.

As their loved one perished, the men — charged with assault, disturbing the peace and obstruction — spent the next three hours handcuffed to a bench in the city’s jail.

Brooke is dead; her family members can’t change that. But they desperately would like to have their names cleared. Unfortunately, there is evidently no room for compassion in this case...

PHILADELPHIA, PA — A family was disturbed by a midnight visit from police, looking for a crime suspect who didn’t live there. As officers searched the home, with three young children present, they fired a gun at a dog that had the nerve to bark at them.

Around 12:30 a.m. on September 30, Bienvenido Gutierrez and his fiancée, Nina Castro, heard sounds coming from the back of their home in the Germantown neighborhood of Philadelphia. Then came an unexpected knock on the front door. It was a half-dozen police officers from the First Judicial Warrant Unit. They had a warrant for the arrest of Bienvenido’s brother, Joshua Gutierrez.

Bienvenido explained to police that his brother had moved out 6 years ago, and was not present in the home. The officers would hear nothing of it, and proceeded to comb the house with guns drawn — even to the bedroom where his three young children were sleeping; ages 7, 2, and 10 months.

A dog sleeping in the children’s bedroom name Suzzie barked at the warrant officers when they intruded upon its protective territory. This was enough for one trigger-happy cop to fire at it in front of the children. The bullet did not strike the dog, or anyone else, but left an impact on the family.

“Their whole demeanor was that they were gonna shoot to kill,” said Bienvenido Gutierrez to NBC10. “They wanted to shoot something.”

SAN DIEGO — A woman who said she was sexually assaulted by former San Diego Police Officer Anthony Arevalos more than three years ago settled a lawsuit against the city on Friday for $795,000.

The settlement was announced in a brief hearing in federal court in San Diego. A lawyer for the city said that the City Council has already approved settling the case for that amount.

The $795,000 is the largest payment the city has made in the flurry of a dozen lawsuits filed by women who said they were harassed or assaulted by Arevalos, a former traffic officer with the department. He was convicted of sexual battery and other charges and in February 2012 was sentenced to almost nine years in state prison.

As many as 263 youth may have been sexually abused by former Saint John police officer Kenneth Estabrooks, during a three-decade period dating back to the 1950s, a private investigator announced on Monday.

It could be one of the worst cases of sexual abuse in Canadian history, according to a Halifax lawyer.

"If what we're learning today is true, Estabrooks is now probably the most prolific serial sexual abuser in Canadian history," said John McKiggan, who is on the verge of filing a class action lawsuit on behalf of Estabrook's victims.

"One just has to wonder how that could have gone on for so long," he said.

Private investigator Dave Perry, whose Toronto-based firm Investigative Solutions Network Inc. was hired by the City of Saint John to look into complaints about the late Estabrooks, said the former officer was an abuser of devastating proportion, affecting generations.

TROY, Ohio — A former Troy police officer has been indicted for felony theft in office for allegedly using a DARE program credit card for personal benefit of more than $13,000.
Kirt E. Wright, 41, of Troy was indicted on the third-degree felony charge by a Miami County grand jury. He was served with a summons to appear in Common Pleas Court for arraignment Oct. 7, according to court documents.
Wright resigned from the police department July 23. County Prosecutor Tony Kendell said Wright is accused of misusing a credit card issued only for the purposes of the schools DARE program. The card was funded with money donated to the program, he said. The charge alleges the thefts occurred between January 2008 and May 30.
Wright worked for the county sheriff’s department from September 1991 through August 1999, when he joined the Troy Police Department. He was assigned a School Resource Officer in 2008.

HOOVER, Alabama - In a lawsuit filed last week, a Hoover woman claims that police waited more than an hour and a half to enter the home where an armed intruder was attacking her 39-year-old daughter.

On Sept. 19, Virginia P. Jamison filed a wrongful death lawsuit against the city in the March death of her daughter, Kimberly Jamison Ozburn. They shared a home at 2305 Queensview Road in Hoover.

The lawsuit lays out this account of the March 19 attack:

Armed with a gun and a knife, Jimmy Lee Frizzell, 55, forced his way into the home at 9:25 p.m. Ozburn called 911 to report the attack.

Moments later, Frizzell put the gun to Ozburn's head and fired two shots, but the weapon misfired. Ozburn and her mother retreated to a bedroom, pursued by Frizzell who subdued Ozburn and sat atop her with a knife pointed at her chest.

Jamison escaped the room and called 911 at 9:28 p.m.

At 9:30 p.m., Hoover officers arrived at the scene, and Jamison immediately explained what had happened and told them where Ozburn and Frizzell were.

"(Jamison) pleaded with the officers on scene to immediately enter the residence, but they refused," the filing says.

Officers called the house phone and Ozburn's cell phone several times between 9:38 and 10:52 p.m., but the calls went unanswered.

At one point, officers tried to open the locked front door, despite Jamison's insistence that they should go through the unlocked side door.

Police entered the home at 11:15 p.m., and Ozburn and Frizzell were pronounced dead minutes later.

A Hoover police spokesman declined to comment on the pending litigation. Attempts to reach the city attorney for comment were unsuccessful...

Zoe Brugger was driving home after picking up her boyfriend from work, when a routine traffic stop turned particularly uncomfortable.

Brugger's headlight was out, which prompted the stop by Lakeland, Florida police officer Dustin Fetz.

Fetz believed that the two were hiding drugs in the car, so he asked Brugger to exit the vehicle. Outside of the car, he asked her to lift up her shirt and shake out her bra - not once, but twice - in order to see if she was concealing anything. The request didn't reveal any drugs, and a subsequent search of the vehicle didn't produce anything either.
